<br />A RESOL TION DECLARING IT NECESSARY TO IMPROVE, IN
<br />COOPERATION WITH THE DIRECTOR OF TRANSPORTATION OF
<br />THE STATE OF OHIO, CLAGUE ROAD, C.R. 52, BY CONSTRUCTING
<br />CONCRETE DRIVEWAY APRONS.
<br />WHEREAS, this Council by Ordinance No. 77-166, passed on October
<br />4, 1977, consented to the improvement of Clague Road from Lorain Road to the
<br />North Olmsted North corporation line by the Director of Transportation of the
<br />State of Ohio; and
<br />WHEREAS, This Council determines that, as part of this
<br />improvement, concrete driveway aprons should be constructed on Clague Road from
<br />approximately 1,000 feet South of Lorain Road to the North corporation line,
<br />the cost of which after deducting any Federal, State or County funds which may
<br />be allocated thereto, will be paid by the City of North Olmsted; and
<br />WHEREAS, this Council determines that a portion of the City's share of
<br />the cost of constructing said driveway aprons should be assessed against the
<br />abutting properties;
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO:
<br />SECTION 1: That it is necessary to imarove, in cooperation with
<br />the Director of Transportation of the State of Ohio, Clague Road from
<br />approximately 1,000 feet South of Lorain Road to the North corporation line by
<br />constructing concrete driveway aprons.
<br />SECTION 2: That said streets shall be improved as shown on the
<br />plans hereinafter referred to and now on file in the office of the Clerk of
<br />this Council.
<br />SECTION 3: That it is hereby determined and declared that said
<br />improvement is conducive to the public health, convenience and welfare of said
<br />City and the inhabitants thereof.
<br />SECTION 4: That the grade of said streets as improved shall be
<br />the grade as shown by the plans and profiles, which have been prepared by the
<br />City's Engineering Department, and which are made a part hereof.
<br />SECTION 5: That the plans, specifications, est.l.mates and profiles
<br />of the proposed improvement, heretofore prepared by the City's Engineering
<br />Department, and now on file in the office of the Clerk of this Council, are
<br />hereby approved.
<br />SECTION 6: That the cost of constructing said driveway aprons
<br />after deducting the amounts allocated thereto from Federal, State or County
<br />funds, less at least 2% and the cost of intersections attributable to the
<br />remainder of such cost, shall be assessed in proportion to the benefits which
<br />may result from the improvement upon all lots and lands bounding and abutting
<br />upon Clague Road between the aforesaid termini, which lots and lands are hereby
<br />determined to be specially benefited by said improvement; and the cost of said
<br />improvement shall include the cost of preliminary and other survelrs, plans,
<br />specifications, profiles, and estimates and of printing, serving and publishing
<br />notices, resolutions, and ordinances, the amount of damages resulting from the
<br />improvement assessed in favor of any owner of land affected by the improvement
<br />and the interest thereon, the costs incurred in connection with the preparation,
<br />levy and collection of the special assessments, the cost of purchasing,
<br />appropriating, and other,vise acquiring therefor any required real estate or
<br />interests therein, expenses of legal services including obtaining an approving
<br />legal opinion, cost of labor and material, and interest on bonds and notes
<br />issued in anticipation of the levy and collection of the special assessments
<br />together with all other necessary expenditures.
