,: . <br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82- 86 <br />BY: DEAN McKAY <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />DETACHED GARAGE LOCATED ON PERMANENT PARCEL NUMBER <br />237-14-51 AT 24139 ELM ROAD IN THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Codified Ordinante Nos. <br />1331.01 to 1331.99 of the City of North Olmsted, the Building <br />Commissioner has determined that the detached garage that has been <br />fire damaged located on Permanent Parcel Number 237-14-51 at 24139 <br />Elm Road in the City of North Olmsted is unsafe, dangerous to human <br />life and hazardous to the safety, health, and public welfare of the <br />citizens of the City of North Olmsted, and <br />WHEREAS, notice to repair, remove, or demolish said building <br />was given by registered mail on August 5, 1981, ordering said title <br />holder to repair, remove, or demolish said building, and to commence <br />such repair, removal or demolition within sixty (60) days of receiving <br />said notice, and <br />WHEREAS, said record title holder, Joseph Corena, failed to <br />reverse the Building Commissioner's order, and also failed to further <br />appeal the decision of the Board of Building Code Appeals to higher <br />tribunal of competent jurisdiction, and at this time has failed to <br />comply with the order of the Building Commissioner. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Council deems it necessary to proceed with <br />the demolition and removal of the unsafe detached garage which has <br />been fire damaged located at 24139 Elm Road, North Olmsted, Ohio, <br />further known as Permanent Parcel No. 237-14-51, owned by Joseph <br />Corena, by reason of the fact that said detached garage has been <br />determined to be dangerous to human life and a hazard to the public <br />safety, health, and welfare of the citizens of the City of North <br />Olmsted, and that the cost of said demolition and the removal be <br />paid from the General Fund of the City of North Olmsted and charged <br />to the owner(s) as a special assessment or lien on such parcel of <br />land and assessed and collected in the manner of other assessments <br />as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />directe to orward a copy of this Ordinance to Joseph Corena, <br />24139 Elm Road, North Olmsted, Ohio 44070. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety, and welfare, and for the further reason <br />that the dilapidated condition of said detached garage is a serious <br />hazard to the health, safety, and wel£are of the citizens of the <br />City of North Olmsted, and £urther provided it receives the affirma- <br />tive vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and approval <br />by the Mayor.
