CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82 - 87 <br />BY: MR. WILAMOSKY <br />AN ORDINANCE AMENDING CHAPTER 753 OF THE BUSINESS <br />REGULATION CODE OF THE CODIFIED ORDINANCES OF THE <br />CITY OF NORTH OLMSTED, ENTITLED "DRUG PARAPHERNALIA; <br />MAINTENANCE OR OPERATION OF A PLACE OF BUSINESS; <br />EXCLUSION OF MINORS; REVOCATION OR DENIAL OF LICENSE", <br />AS AMENDED. <br />WHEREAS, the Council of the City of North Olmsted desires to <br />further amend its licensing ordinance regulating the sale of drug <br />paraphernalia to better control such sales so that the adverse <br />effects of such sales and displays of drug paraphernalia upon minors <br />will be minimal. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 753.09, entitled "Periodic <br />Inspection", an 753.11, entitled "Penalty", of Chapter 753 of the <br />Business Regulation Code, entitled "Drug Paranhernalia; Maintenance <br />of Operation of a Place of Business; Exclusion of Minors; Revocation <br />or Denial of License", which now reads: <br />"753.09 PERIODIC INSPECTION. <br />The owner or proprietor of every establishment licensed under <br />this Chapter shall at all times permit access to the Director of <br />Public Safety or his designee (s), for the purpose of periodically <br />inspecting the establishment." <br />"753.11 PENALTY. <br />(A) Notwithstanding any other nrovision of law, including <br />2925 Ohio Revised Code, or similar legislation adopted by the City, <br />violation of this section shall not constitute a criminal offense, <br />but oneration of a business in violation of the provisions of this <br />section shall be grounds for revocation or nonrenewal of any license, <br />permit, or other entitlement previously issued by the City of North <br />Olmsted for the privilege of engaging in such business and shall <br />be grounds for denial of any future license, permit, or other <br />entitlement authorizing the conduct of such business or any other <br />businesses, if the business includes the sale of drug paraphernalia," <br />be and the same are hereby amended, and as amended shall read as <br />follows: <br />753.09 RECORDS AND INSPFCTION. <br />Every licensee must keep a record of every item of drug <br />paraphernalia, as that term is defined in Section 753.04 of this <br />Chapter, which is sold, and this record shall be open to the in- <br />spection of the Director of Public Safety, the Chief of Police, and any <br />police officer of the City at any time during the licensee's hours <br />of business. Such record shall contain the name and address of the <br />purchaser and the proper identification be required at the time of <br />nurchase; the name and auantity of the item of drug paraphernalia; <br />the date and time of the sale; and the signature of the licensee or <br />the licensee's agent. Such record shall be retained by the licensee <br />for a period of not less than two years.
