CITY OF NORTH OLMSTED ORDINANCE N0. 82 - 87 BY: MR. WILAMOSKY AN ORDINANCE AMENDING CHAPTER 753 OF THE BUSINESS REGULATION CODE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED, ENTITLED "DRUG PARAPHERNALIA; MAINTENANCE OR OPERATION OF A PLACE OF BUSINESS; EXCLUSION OF MINORS; REVOCATION OR DENIAL OF LICENSE", AS AMENDED. WHEREAS, the Council of the City of North Olmsted desires to further amend its licensing ordinance regulating the sale of drug paraphernalia to better control such sales so that the adverse effects of such sales and displays of drug paraphernalia upon minors will be minimal. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Sections 753.09, entitled "Periodic Inspection", an 753.11, entitled "Penalty", of Chapter 753 of the Business Regulation Code, entitled "Drug Paranhernalia; Maintenance of Operation of a Place of Business; Exclusion of Minors; Revocation or Denial of License", which now reads: "753.09 PERIODIC INSPECTION. The owner or proprietor of every establishment licensed under this Chapter shall at all times permit access to the Director of Public Safety or his designee (s), for the purpose of periodically inspecting the establishment." "753.11 PENALTY. (A) Notwithstanding any other nrovision of law, including 2925 Ohio Revised Code, or similar legislation adopted by the City, violation of this section shall not constitute a criminal offense, but oneration of a business in violation of the provisions of this section shall be grounds for revocation or nonrenewal of any license, permit, or other entitlement previously issued by the City of North Olmsted for the privilege of engaging in such business and shall be grounds for denial of any future license, permit, or other entitlement authorizing the conduct of such business or any other businesses, if the business includes the sale of drug paraphernalia," be and the same are hereby amended, and as amended shall read as follows: 753.09 RECORDS AND INSPFCTION. Every licensee must keep a record of every item of drug paraphernalia, as that term is defined in Section 753.04 of this Chapter, which is sold, and this record shall be open to the in- spection of the Director of Public Safety, the Chief of Police, and any police officer of the City at any time during the licensee's hours of business. Such record shall contain the name and address of the purchaser and the proper identification be required at the time of nurchase; the name and auantity of the item of drug paraphernalia; the date and time of the sale; and the signature of the licensee or the licensee's agent. Such record shall be retained by the licensee for a period of not less than two years.
