CITY OF NORT11 OL MsTED RESOLUTION NO. 2019 - 65 By: Mayor Kennedy and Councilperson Schumann A RESOL UTION A UTHORIZING THE MA YOR, ON BEHALF OF THE CITY OF NORTH OLMSTED, TO ENTER INTO A LICENSE AGREEMENT WITH BRF_TTON RIDGE HOMEOWNERS ASSOCIATION, GRANTING PERMISSION TO INSTALL DEVELOPMENT IDENTI FICA TION SIGATS IN THE PUBLIC RIGHT- OF-WAY ON DORCHESTER ROAD AND IN THE VICINITY OF STEA RNS ROAD, .4 ND DECLARING AN EMERGENCY, WHEREAS, the Bretton Ridge Homeowners Association proposes to install a new identification sign at the entrance to the subdivision on Dorchester Road, in the vicinity of Stearns Road; and WHEREAS, private property owners have consented to the installation ofthe signage on the tree lawn in front of their property; and WHEREAS, the Director of Planning and Development has reviewed and recommended approval of the proposed signage, elevations for which are attached; and WHEREAS, the City Engineer has reviewed and recommended approval of the proposed location: and WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter into a License Agreement with Bretton Ridge homeowners Association, care of Jon Jarc, its President, located at 6357 Stafford Drive, North Olmsted, Ohio 44070, and John and Julia Treska, residing at 29151 Dorchester Road, City ol'North Olmsted. Ohio 44070 (PPN 234-31-001) in order to allow construction of identification signs within the Citv's right ofway. NOR, THEREFORE., BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STA TE OFOHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a license Agreement with Bretton Ridge I lomeowners Association , care of Jon .tare, its President, located at 6357 Stafford Drive, North Olmsted, Ohio 44070, and John and Julia Treska, residing at 29151 Dorchester Road, City of North Olmsted, Ohio 44070 (PPN 234-31-001). The License Agreement shall be in form and substance substantially similar to the attached License Agreement, marked as Exhibit A, and attached hereto, with only such changes to be hereinafter made in said contract as are not substantially adverse to the City and which are approved by the Director of Law. The character ofany such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the public health, safety and welfare to expedite installation of signage; and further provided it receives the affirmative vote oftwo thirds of the members of Council, it shall
