CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2020 - 157 <br />BY: Mayor Kennedy <br />AN ORDINANCE GRANTING AN EASEMENT TO THE <br />CLEVELAND ELECTRIC ILLUMINATING COMPANY FOR <br />THE INSTALLATION AND MAINTENANCE OF ELECTRIC <br />SERVICE AT THE NORTH OLMSTED RECREATION <br />CENTER PROPERTY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Cleveland Electric Illuminating Company has requested that the City grant <br />an Easement for the installation and maintenance of electrical utilities as necessary for service of <br />a cellular communication tower at the North Olmsted Recreation Center property; and <br />WHEREAS, it is the desire of this Council, upon the recommendation of the Director of <br />Planning and Community Development, to grant an Easement to the Cleveland Electric <br />Illuminating Company for electrical utilities at the North Olmsted Recreation Center property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor of the City of North Olmsted be and he is hereby <br />authorized to sign and convey, on behalf of the City, an electrical utility Easement to the <br />Cleveland Electric Illuminating Company, in substantially the same form as attached Exhibit A. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary to provide electrical utility service for systems in accordance <br />with utility regulations, and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage. <br />PASSED: I 2lZ <br />ATTEST: � <br />CHARLES MASSA ROL0 H <br />Clerk of Council <br />APPROVED: I ^ Z) -�,I <br />M YOR KEVIN M.
