CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2021 - 3 <br />By: Councilwoman Hemann <br />A RESOLUTION ESTABLISHING THE "TEMPORARY INDOOR DINING <br />PROGRAM" AND DECLARING AN EMERGENCY. <br />WHEREAS, during the COVID-19 public health emergency, City of North Olmsted <br />dining establishments first endured the hardship of being temporarily closed in North Olmsted <br />and now are struggling with restricted seating capacity; and <br />WHEREAS, to provide dining options that best suit the individual needs of patrons and <br />restaurant owners, the City desires to establish and promote a temporary program permitting <br />expanded indoor dining by and through the use of vacant commercial spaces in close proximity <br />to the Permanent Licensed Business/Licensed Food Business establishment; and <br />WHEREAS, the Cuyahoga County Board of Health has assisted in establishing <br />guidelines to implement this temporary indoor dining area program; and <br />WHEREAS, it is the desire of this Council to establish a temporary expanded indoor <br />dining area program for the Permanent Licensed Business/Licensed Food Business in the <br />community struggling with COVID-19 restrictions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That vacant indoor commercial space in the same commercial plaza or on <br />the same parcel upon which is located a current, operating restaurant, is available under the <br />Zoning Code in the City of North Olmsted to be used for potential additional patron seating and <br />dining. <br />SECTION 2: That there is hereby established the "Temporary Indoor Dining Program" <br />in the City of North Olmsted and the guidelines and processes for securing authorization and use <br />of vacant space for dining use are attached hereto and incorporated herein as Exhibit A. <br />SECTION 3: Although the program developed herein was created with the cooperation <br />of the Cuyahoga County Board of Health and the City of North Olmsted and is offered as a <br />streamlined way to achieve an approved temporary indoor dining status, nothing in this <br />Resolution shall be construed as authorization for any restaurant operator to occupy a currently <br />vacant commercial space for patron seating and dining purposes without compliance with state <br />codes or local codes. This includes, but is not limited to, the Ohio Building Code, Ohio Liquor <br />Control Law, the Ohio Fire Code and the rules and regulations enforced by the Cuyahoga County <br />Board of Health. <br />
