CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2021 - 23 <br />By: Mayor Kennedy <br />A RESOL UTION A UT HORIZING THE t11A YOR TO PURCHASE ONE (1) <br />KUBUT9 MINI EXCAVATOR AND TRAILER FROM AKRON TRACTOR & <br />EQUIPMENT AT A COST OF $102,596.00 THROUGH THE ST4TE <br />PURCHASE PROGRAM, AND FURTHER AUTHORIZING THE MAYOR <br />TO EXECUTE .ALL CONTRACT DOCUMENTS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Mayor recommends that the City acquire one (1) new Kubuta Model <br />KX080-4SR3A (mini excavator), together with the trailer, for use by the Service Department <br />fi-om Akron Tractor & Equipment at a total cost of $102,596.00, as established and quoted on the <br />State Purchase Program; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said <br />equipment through the State Purchase Program and to further authorize the Mayor to execute any <br />contract documents required for such expenditure with Akron Tractor & Equipment. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUI:AHOGA, AND STA TE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />State Purchase Program, which was established by R.C. Section 125.04, and which the City is <br />authorized to participate in pursuant to the City Charter and Resolution No. 87-6, one (1) new <br />Kubuta Model KX080-4SR3A (mini excavator), together with the trailer, at a cost of <br />$102,596.00, from Akron Tractor & Equipment, all of which is described in the specifications on <br />file in the Safety Department and the purchase docu vents attached hereto as Exhibit A. The <br />Mayor is hereby authorized to execute contract documents, as necessary, to effectuate the State <br />Purchase Program. Any contracts executed by the Mayor shall be in a form and substance <br />consistent with the provisions of this Resolution and be approved by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation Of the public health, safety and welfare and for the <br />further reason that immediate authorization will expedite delivery, which is estimated to be <br />delayed by 60 to 90 days, and further provided that it receives the affirmative vote of two-thirds <br />of all members of Council, it shall take effect and he in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: 4 C- I <br />Fh'St Reculing.
