CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 - 68 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MA YOR TO ENTER INTO A <br />CONTRACT WITH THE STATE OF OHIO DEPARTMENT OF <br />TRANSPORTATION FOR THE PURPOSE OF ACQUIRING STATE <br />OWNED PROPERTY FOR LOCAL PUBLIC PURPOSE. <br />WHEREAS, the City of North Olmsted identified four (4) parcels owned by the State of <br />Ohio that may be suitable for future city infrastructure improvements and the State of Ohio <br />agreed to transfer the same; and <br />WHEREAS, the properties are proposed to be transferred to the City via an agreement <br />proposed by the Department of Transportation and reviewed by the Director of Law; and <br />WHEREAS, CT Consultants has provided necessary surveying and platting so that the <br />properties may be recorded with Cuyahoga County upon execution; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to execute the <br />contracts for acquisition and to accept the four (4) parcels of land. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to execute the contract <br />attached hereto as Exhibit A with the State of Ohio for the purpose of acquiring real property to <br />be used for local public purpose. Said contract shall be in a form that is not substantially adverse <br />to the City and which is approved by the Director of Law. The character of any content not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Ordinance shall take effect and be in force from and after the <br />earliest period allowed by law upon its passage and approval by the Mayor. <br />PASSED: N, Ve' ((; <br />ATTEST: <br />First Reading: <br />Second Reading: 11 <br />Third Reading: <br />Committee: r; r•ti C� CCS <br />
