CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 - 2 <br />BY: Mayorlones <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 171 <br />OF THE ADMINISTRATIVE CODE ENTITLED "COMMUNITY <br />REINVESTMENT" IN ORDER TO UPDATE THE STANDARDS AND <br />PROTOCOLS FOR AWARDING AND MANAGING TAX ABATEMENT, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Cilc of North Olmsted in 1942, via ordinance 91-175 created a <br />Community Reinvestment Area ("CRA") under the provisions of R.C. §3735.65 through R.C. <br />§3735,70: and <br />WHEREAS, Ordinance 91-175 has been amended from time to time and its provisions <br />are currently codified at Chapter 171. also as amended front time to time: and <br />WHEREAS, in 2014-5 1. the City, eliminated tax abatement on residential remodeling, but <br />preserved tax abatement opportunities on new construction for dwellings containing not more <br />than three (3) housing units: and <br />WHEREAS. this Administration wishes to eliminate the remaining tax abatement <br />opportunities lur new residential construction in the City of North Olmsted. <br />WHEREAS. it is the desire of this Council. consistent with the recommendations of the <br />Administration, to amend and re-establish Chapter 171 of the Administrative Code to eliminate <br />tax incentives for residential new construction. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION I: 'that ( hapter 171 "C'omnnmity, Reinvestment"' which presenth reads in its <br />entirety, as set forth in Exhibit A. which is attached to this Ordinance and incorporated by <br />reference as if fully rewritten herein, shall be amended and. as amended, shall read in its entirety, <br />as set forth also in Exhibit A. with such additions signified by boldface text and deletions <br />signified by language that has been stricken. <br />SECTION 2: That any Ordinance or part of Ordinance in conflict or inconsistent with <br />this Ordinance, is. to the extent of ane such conflict or inconsistency, repealed. C'.onllicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: that this Ordinance is hereby declared to be an emergency measure <br />immediately necessaq for the preservation of the public health, safety, and welfare, and for the <br />lurihe'reason it is necessary that this legislation go into effect immediately in order that the City <br />
