CITY OF NORTH OLMSTED ORDINANCE NO. 2023 - 69 By: Mayor Jones AN ORDINANCE AMENDING SECTION 902.03 ENTITLED ANNUAL REGISTRATION REQUIRED" OF CHAPTER 901 OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE OF THE CITY OF NORTH OLMSTED, ENTITLED "USE OF PUBLIC RIGHT-OF-WAY BY SERVICE PROVIDERS AND CONTRACTORS PERFORMING WORK OF SERVICE PROVIDER FACILITIES" IN ORDER TO PROVIDE FOR ANNUAL REGISTRATION FEES. WHEREAS, Section 902.03, "Annual Registration Required" of Chapter 902 of the Codified ordinances of the City of North Olmsted provides the framework for the registration of service providers and contractors that occupy the municipal right-of-way and provides for the disclosure of information regarding same; and WHEREAS, the City Engineer, upon the advice and concurrence of the Director of Law, recommends amendment of Section 902.03 for the purpose of imposing an administrative fee in order to recover the administrative expenses associated with review of registration materials; and WHEREAS, this Council wishes to amend the Code to enable the Engineering Department to recover administrative expenses of registration review. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. SECTION 1: That section 902.03 of the Streets, Utilities and Public Services Code, which currently reads, in its entirety, as follows: 902.03 ANNUAL REGISTRATION REQUIRED. (a) Annual Registration Required. All Service Providers and Contractors with consent to occupy or use the Right -of -Way as provided in Section 902.02 shall register with the City each calendar year between January 1 and January 31 on a form provided by the City Engineer. (b) Purpose of Annual Registration. The purpose of Annual Registration is to assist the City in monitoring use of the Right -of -Way; to maintain an accurate and current database of information concerning Service Providers that occupy or use the Right -of - Way; and to assist the City in managing the Right -of -Way in a manner that best serves the public health, safety and general welfare. (c) Information Required for Annual Registration. Registration forms will be provided by the City Engineer and shall require the following information: (1) Any material changes to the information the Service Provider or Contractor provided the City in the application for consent to occupy or use the Right- of - Way or Initial Registration, including, but not limited to:
