CITY OF NORTH OLMSTED ORDINANCE NO. 2025 - 4 By: Mayor Jones AN ORDINANCE AMENDING ORDINANCE 1024-18 TO CORRECT AN ERROR IN THE SEWER SERVICE AREA MAP ATTACHED THERETO AS EXHIBIT B. WHEREAS, the City of North Olmsted previously negotiated amendment of and restated its Sewer Service Agreement with Cuyahoga County (dated 10/23/13), pursuant to authorization granted by Council by Ordinance 2013-88, in conjunction with capital improvements to the Wastewater Treatment Plant ("W WTP"), serving a portion of County's Sewer District No. 14. This Agreement included a Service Area map; and WHEREAS, in 2016, the Service Area map adopted in 2013 was amended via Ordinance 2016-77 to remove four (4) parcels from the service area; and WHEREAS, in 2024 the Cuyahoga County Department of Public Works ("CCDPW approached the City of North Olmsted with a request to further change the Service Area map for the sewage treatment of a certain area of Fitch Rd. in Olmsted Township, which was approved under Ordinance 2024-18; and WHEREAS, Exhibit A included with Ordinance 2024-18 erroneously included the four (4) parcels of property back into the service area that were removed from the service area under Ordinance 2016-77; and WHEREAS, the four parcels: 264-24-002, 264-16-003, 264-16-004, 264-16-007 as shown in Attachment A hereto are to be removed from Exhibit B in Ordinance 2024-18 in order to conform with Ordinance 2016-77; and WHEREAS, the amended and corrected Service Area map shown in Attachment B hereto shall be the accurate Facilities Planning Area map and shall serve as an Amended Exhibit B to 2024-18. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. SECTION 1: That Ordinance 2024-18 be and the same is hereby Amended at Exhibit B and as amended the Service Are map attached hereto as Attachment B shall constitute a revised Exhibit B to 2024-18. SECTION 2: This Council finds and determines that all formal actions of this Council and of any of its committees concerning and relating to the passage of this ordinance were taken, and that all deliberations of this Council and of any committees that resulted in those formal actions were held, in meetings open to the public in compliance with the law.
