CITY OF NORTH OLMSTED <br />ORDINANCE NO.2025 - 64 <br />BY: Mayor Jones <br />AN ORDINANCE REPEALING CHAPTER 559 OF THE NORTH <br />OLMSTED CODIFIED ORDINANCES ENTITLED "ALARM <br />SYSTEMS"AND DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Public Safety and Chief of Police have, during the <br />course and scope of administering Chapter 559, Alarm Systems, observed that the <br />regulations are antiquated in relation to modern business practices and no longer <br />necessary to protect the health, safety and general welfare of North Olmsted residents; <br />and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the <br />recommendation of the Administration, to repeal Chapter 559 of the North Olmsted <br />Codified Ordinances. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Chapter 559 of the North Olmsted Codified Ordinances is <br />hereby repealed. <br />SECTION 2: That all other ordinances or resolutions, or parts of ordinances or <br />resolutions, that are inconsistent or in conflict with the repeal of Chapter 559 of the North <br />Olmsted Codified Ordinances are likewise repealed to the extent of such inconsistency or <br />conflict only. This includes, but is not limited to, Chapter 561.01 "Criminal Nuisance <br />Activities Declared" at (a)(13) only which declares a violation of 561.01 for "Any alarm <br />system violation under Section 559.07 (False Alarms) of the Codified Ordinances" which <br />subsection is likewise repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that it is necessary that this Ordinance go into effect immediately so as to <br />allow the City to swiftly eliminate outdated and infective regulations imposed against <br />businesses and residences alike; and further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />
