CITY OF NORTH OLMSTED <br />ORDINANCE NO.2026 - 63 <br />BY: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO REQUEST PROPOSALS FROM PERSONS OR <br />FIRMS TO CONDUCT AN OPERA TIONSAND RATE STUDY FOR <br />THE WASTEWATER TREATMENT PLANT, AND FURTHER <br />A UTHORIZING THE MAYOR TO ENTER INTO ANAGREEMENT <br />WITH THE PERSON OR FIRM SELECTED IN THE RFP <br />PROCESS AS APPROVED BY THE BOARD OF CONTROL. <br />WHEREAS, it is the desire of the Administration and this Council to authorize the <br />Director of Public Service to issue requests for proposals to qualified firms or persons for <br />the purpose of conducting an operations and rate study for the Wastewater Treatment Plant <br />for an eight (8) year period (2028-2036). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he hereby is authorized, <br />in accordance with the provisions of Sections 111.03 et seq, of the Administrative Code, <br />to request proposals from qualified persons or firms to conduct an operations and rate study <br />for the Wastewater Treatment Plant, in accordance with the Request for Proposals on file <br />in the Service Department. <br />SECTION 2: That the Mayor be and she hereby is authorized, upon approval of <br />the Board of Control, to enter into an agreement with the professional person or firm <br />selected in the RFP process. Said agreement shall be substantially in the form and substance <br />of the City's standard professional services agreement, with such changes in the form and <br />substance of such standard form that are not substantially adverse to the City and which <br />are approved by the Director of Law. The character of any such changes as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 3: That this Resolution shall take effect and be in force from and after <br />the earliest period allowed by law upon its passage and approval by the Mayor. <br />PASSED: I /� <br />First Reading: 7 S(,ZOO <br />Second Reading:Lp <br />, <br />Third Reading. — M-� <br />Committee: ��/ A � <br />
