ORDINANCE N0. 84`-2 <br />INTRODUCED BY: Mayor and Council as a Whole <br />AN ORDINANCE CONFIRMING THE <br />APPOINTMENT OF A PROSECUTOR, <br />ESTABLISHING COMPENSATION THEREFOR, <br />AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1.. The Mayor's appointment of Vincent A. Feudo, <br />as Prosecutor for Mayfield Village is hereby confirmed subject to the <br />terms, conditions and compensation hereinafter established. <br />Section 2. The appointment confirmed herein shall be <br />effective until December 31, 1984 or until the appointment of a <br />successor Prosecutor, whichever is later, except that either the <br />municipality or the Prosecutor may terminate the employment of the <br />Prosecutor upon providing thirty (30) days written notice to the other <br />of intention to so terminate. <br />Section 3 The Prosecutor shall be compensated at the <br />rate of Five Hundred Twenty-Five Dollars ($525.00) per month for all <br />services rendered to the municipality in such capacity except as <br />herein otherwise provided. While in attendance at all trials and <br />pretr_ials in the Lyndhurst Municipal Court on criminal charges brought <br />by Mayfield Village either under its own Codified Ordinances or under <br />the Revised Code of the State of Ohio, and including preliminary <br />hearings in the Lyndhurst Municipal Court on felony charges arising <br />out of Mayfield Village, the Prosecutor shall be compensated at the <br />rate of Fifty Dollars (550.00) per hour, payable upon submission of <br />reasonably detailed billings indicating the name of the case, the date <br />and nature of the proceeding and the time spent. It is understood <br />that such services are rendered by the Prosecutor as an independent <br />contractor and that he is not an employee of the municipality. <br />1984. <br />Section 4 This Ordinance shall be effective January 1, <br />Section 5 The Prosecutor shall be responsible directly <br />to the Mayor and shall not be under the supervision or control of the <br />Law Director. <br />Section 6. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />
