ORDINANCE NO. 80-1 <br />INTRODUCED BY: Mayor and.Council as a ~:Jhole <br />AN ORDINANCE CONFIRMING .THE APPOINTMENT OF <br />A LAW DIRECTOR AND ESTABLISHING COMPENSATION <br />FOR SUCH POSITION. <br />WHEREAS, the law firm of Avery, Feneli and Carbone and its <br />predecesors in interest have provided legal representation to Mayfield <br />Village, Ohio, since November, 1977; and <br />WHEREAS, Mayor Robert G. Beebe has indicated to Council the <br />exercise of his appointing authority 'in favor of Guerin L. Avery as <br />Law Director for a two-year term commencing January 1, 1980; and <br />WHEREAS, Council wishes to confirm such appointment and to <br />establish a revised system of compensation; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The contract between Mayfield Village and Avery, <br />Feneli and Associates for the administration of the Law Department of <br />Mayfield Village for all civil municipal purposes is hereby continued <br />in full force and effect as between the Village and Avery, Feneli and <br />Carbone, successors in interest to Avery, Feneli and Associates, subject <br />only to the amended system of compensation set forth herein. <br />Section 2. The law firm shall be compensated according to the <br />following schedule: <br />(a) For attendance at regular Council meetings, Council <br />Caucuses and the regular meeting of the Planning Commission, plus such <br />other meetings of boards, commissions and Council at which attendance <br />of an attorney is requested, not to exceed an average of four (4) <br />meetings per month during any calendar year, as well as routine oral <br />conferences by telephone or at City Hall or in the law firm's office <br />with municipal personnel and officials, together with preparation of <br />all ordinances, ,resolutions and proclamations, a monthly retainer of <br />Seven Hundred Dollars ($700.00) per calendar month, payable in advance <br />on the first day of each month, commencing with and retroactive to <br />January 1, 1980; .. - " <br />(b) For all of the services requested or authorized and not <br />specifically set forth in subsection (a) above, a charge of Fifty Dollars <br />($50.00) per hour, subject to a maximum of Four Hundred Dollars ($400.00) <br />for any one calendar day; <br />
