`~~ ORDINANCE NO. 80- 3 <br />v ,~~ <br />INTRODUCED BY: Mayor and _Council as a 6^Jhole <br />AN EMERGENCY ORDINANCE CONFIRMING THE <br />APPOINTMENT OF A PROSECUTOR AND ESTABLISHING <br />COMPENSATION THEREFOR. <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor's appointment of Vincent A. Feudo <br />as Prosecutor for Mayfield Village is hereby confirmed. <br />Section 2. Effective January 1, 1980, the Prosecutor <br />shall be compensated at the rate of Five Hundred Twenty Five Dollars <br />($525.00) per month for all services rendered to the municipality <br />in such capacity except as herein otherwise provided. While in <br />attendance at trials and for second and subsequent pretrials pertaining <br />to the same case in the Lyndhurst Municipal Court on criminal charges <br />brought by Mayfield Village either under its own Codified Ordinances <br />or under the Revised Code of the State of Ohio, and including preliminary <br />hearings in the Lyndhurst Municipal Court on felony charges arising <br />out of Mayfield Village, the Prosecutor shall be compensated at the <br />rate of Fifty Dollars ($50.00) per hour, payable upon submission of <br />reasonably detailed billings indicating the name of the case, the date <br />and nature of the proceeding and the time spent. It is understood <br />that such.serv~ces are rendered by the Prosecutor as an independent <br />contractor and that he is not an employee of the municipality. <br />Section 3. This contract shall be effective until December <br />31, 1981 or until the appointment of a successor Prosecutor, whichever <br />is later. <br />Section 4. The Prosecutor shall be responsible directly <br />to the Mayor and shall not be under the supervision of the Law Director. <br />Section 5. This is an emergency Ordinance immediately <br />necessary for the preservation of the health, safety and welfare of the <br />residents of Mayfield Village in that it provides for necessary <br />government services.
