RESOLUTION N0. 80- 8 <br />BY: Council as a Whole <br />AN EMERGENCY RESOLUTION URGING THE LEGISLATURE <br />TO AMEND THE OHIO REVISED CODE SO THAT MEMBERS <br />OF THE PUBLIC UTILITIES COMMISSION ARF. DIRECTLY <br />ELECTED BY THE VOTERS OF THE STATE OF OHIO. <br />WHEREAS, Section 4901.02 of the Ohio Revised Code provides <br />that the members of the Public Utilities Commission be appointed by <br />the Governor for six (6) year terms; and <br />WHEREAS, it is the people of the State of Ohio that must <br />bear the financial burden of any decisions reached by the members of <br />the Public Utilities Commission; and <br />WHEREAS, it is the firm belief of this Council that the <br />direct election of the members of the Public Utilities Commission <br />by the qualified electors of this State would make that regulating <br />body more responsive to the people of the State; nova, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio urges <br />the members of the Legislature to draft and enact legislation amending <br />Section 4901.02 of the Ohio Revised Code, and any other sections <br />pertinent thereto, so that the members of the Public Utilities Com- <br />mission are directly elected by the voters of the State of Ohio. <br />Section 2. The Clerk of Council be and is hereby authorized <br />and directed to forward a copy of this Resolution to Governor James A. <br />Rhoades, the Clerk of the Ohio Senate and House of Representatives, <br />State Representative Matthew Hatchadorian and State Senator Anthony O. <br />Calabrese. <br />Section 3. This Resolution is declared to be an emergency <br />measure immediately necessary for the preservation of the public <br />health, safety and general welfare of the residents of Mayfield <br />Village, Ohio in that its direct goal is the more efficient govern <br />ment of the State and, more specifically, a more responsive method <br />of selecting that governmental body responsible for regulating the <br />Public Utilities operating within the State. It shall therefore talce <br />effect immediately upon passage by the affirmative vote of not less <br />
