ORDINANCE NO. 80- 15 <br />INTRODUCED BY: Mr, Bennett <br />AN EMERGENCY ORDINANCE REPEALING ORDINANCE 79-73 <br />WHEREAS, this Council did, on October 15, 1979, pass <br />Ordinance 79-73 entitled <br />"AN ORDINANCE LEVYING ASSESSMENTS FOR THE IMPROVE- <br />MENT OF ECHO DRIVE LOCATED WITHIN HAYFIELD VILLAGE, <br />OHIO, BY HAVING IT REPAVED AND REDITCHED" <br />WHEREAS, it has now been determined that the Ordinance <br />was prematurely passed for the reason that the actual cost <br />of the improvement had not been definitely ascertained; and <br />WHEREAS, upon completion of the project and the ascertain- <br />ment of the actual cost, Council intends to pass a correct ord- <br />inance levying assessments for the improvement of echo Drive; <br />_ NOW, THEREFORE, be it ordained by the Council of Mayfield <br />Village, Ohio, that: <br />Section 1. Ordinance 79-73 is repealed in its entirety. <br />Section 2. This is an emergency ordinance immediately <br />necessary for the preservation of the health, welfare and <br />safety of the residents of Mayfield Village, Ohio, for the <br />reason that the placing of incorrect assessments on the tax <br />rolls would Beverly burden the ability of Mayfield Village to <br />finance other needed governmental operations. It shall therefore <br />take effect immediately upon passage by the affirmative vote of <br />not less than five members elected to Council and approval by <br />the Mayor or otherwise at the earliest time allowed by law. <br />Section 3. Immediately upon passage of this Ordinance, the <br />Clerk of Council is authorized, empowered and directed to certify <br />a copy of it to the Auditor of Cuyahoga County and to certify <br />a further copy to bond counsel, Hahn, Loeser, Dean, Freidheim and <br />Wellman, attention Steven J. Knerly, Jr., Esq. <br />~,,-~./ <br />President of Council <br />
