ORDINANCE N0.2 ~~ <br />AN ORDINANCE PROVIDING FOR THE EiuiPLOYN~NT OF LEGAL COUNSED FOR <br />THE VILLAGE OF 1~AYFIELi~. <br />WHEREAS, the Council. deems it for the best interest of the Village <br />to provide legal counsel for the same :and for the officers thereofo <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of <br />Mayfield, Cuyahoga County, State of~Ohios . <br />Section 1. That Frederick W. Darn, xttarney~at--law be and he is <br />hereby employed to act :as legal counsel for said Village and the officers thereof <br />in their official capacity, ,and as such to prosecute or defend all :actions, by or <br />.against said Village, or any department or officer thereof. <br />Section 2. That he shall prepare and submit to the Council :all <br />resolutions and ordinances of whatsoever character or nature necessary, for all <br />public improvements :and for the issuance of bonds and every purpose .authorized <br />by laws :and that he shall prepare:all other resolutions .and ordinances as such <br />are requested by this Council or any department of this Village. <br />Section 3. That he shall beyappointed for a periad of two (2) years <br />ending December 31, 195,, and shall. receive as compensation the sum of Six <br />Hundred Dollars (~60Q.00) per :annum, payable in equal monthly installments, which <br />compensation shall cover all general services rendered the said Village as such <br />legal counsels provided, however, that said legal counsel shall be paid.additional <br />compensation in the. amount of One Flundred Doll=ors (~IOO.0O) for Legal services <br />rendered in a onnection there~arith, which:additianal compensation shall, in <br />the case of :a special:assessment improvement, be charged .against the respective <br />improvement and shall be included .as a part of the cast thereof,.and provided, <br />further that he shall receive the sum of Twenty five Do3lars 025.00) per diem for <br />time spent in courts other than in Mayarfs Court, in the Litigation of Village <br />matters. The compensation herein ~rQVided fors except that to be charged against <br />~. special :assessment improvement, shall be payable out of the General Fund~of said <br />Village. <br />Section 4. That :any necessary reasonable expenses incurred in the <br />performance of its dutiesshall, after being approved by this Council. be :auuthorized <br />to be paid. <br />Section 5. This Ordinance is hereby dechared to be an Emergency <br />Ordinance necessary for the immediate preservation of the public health and safety <br />for reasons apparent from the contents of this Ordinance. <br />Passed the 21st day of January, ~.
