RESOLUTION N0. 84- 14 <br />IIVTRODUCED BY: Mayor Fred N. Carmen <br />A RESOLUTION AUTHORIZ ING THE <br />DIRECTOR OF LAW TO MONITOR AND <br />PARTICIPATE, WHERE REQUIRED, IN THE <br />DEFENSE OF THE LITIGP,TION FILED BY <br />THE ESTP,TE OF GERALD N. SCHAJATOVIC <br />AND DECLARING AN EMERGENCY, <br />WHEREAS, Gerald N. Schajatovic, Administrator of the Estate <br />of Reith G. Schajatovic, Deceased, has commenced an action in the <br />Cuyahoga County Court of Common Pleas arising from the suicide death <br />of his son, Keith G. Schajatovic, in the Mayfield Village Police <br />Department on or about May 7, 1983; and <br />WHEREAS, the demand for judgment included in the afore- <br />mentioned litigation far exceeds the limits of liability currently <br />available in all municipal insurance policies applicable to this <br />claim; and <br />WHEREAS, the Mayor and Council have determined that it is in <br />the best interests of the municipality to authorize the Director of <br />Law to monitor the defense of the aforementioned litigation and, where <br />applicable, to participate in said litigation in order to protect the <br />interest of the taxpayers of the municipality; now, therefore, <br />BE IT RESOLV ED BY THE COUNCIL OF MP,YF IELD V ILLAGE, OH IO, THAT s <br />Section 1. The Director of Law of Mayfield Village is <br />hereby authorized and directed to monitor the def ense of the current <br />action pending in the Cuyahoga County Court of Common Pleas styled <br />Gerald N Schajatovic, Administrator of the Estate of Keith G. <br />Schajatovic, Deceased v. The Village of Mayfield, et al., and where <br />applicable, to participate in the defense of the said litigation. <br />section 2o The Director of Law is hereby further required <br />to report to the Mayor and Council of the municipality on the status <br />of the pending action, including all settlement negotiations, as each <br />substantive phase of the litigation evolves. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory reguirements including the requirements of <br />Section 121.22 of the Ohio Revised Code.
