Carmen <br />A RESOLUTION AUTHORIZ ING THE MAYOR AND DIRECTOR OF <br />FINANCE TO ENTER INTO A CONTRACT WITH P,RI CONSTRUCTION <br />COMPANY IN A1V AMOUIVT NOT TO EXCEED TEN THOUSAND THREE <br />HUNDRED SIXTY FOUR DOLLARS ($10,364.00) FOR THE <br />CONSTRUCTION OF CERTAIIV DRAIIV IMPROVENIENTS ON WOODLANE <br />DRIVE, DECLARING THE SAME TO BE AN EMERGENCY EXPENDI- <br />TURE AND DECLARING AN ENLERGENCY. <br />WHEREAS, the Mayor anci Council of Mayfield Village have been <br />advised by the Building Commissioner and Village Engineer that because <br />of certain clrainage deficiencies sanitary sewer effluent is flowing <br />above ground on the properties abutting Woodlane Drive within the <br />municipality; and <br />WHEREAS, the aforementioned condition constitutes a real and <br />immediate hazard to the health, safety and welfare of the residents of <br />the municipality living on Wooc3lane Drive as well as those residents <br />residing within the immediate vicinity; and <br />WHEREAS, the Village Engineer has been able to obtain a <br />price quotation in an amount not to exceed Ten Thousand Three Hundred <br />Sixty Four pollars ($10,364.00) from ARI Construction Company in order <br />to perf orm the necessary construction work to alleviate this health <br />hazard; and <br />WHEREAS, the serious and immediate health hazard presented <br />to the residents in the Woodlane Drive area by the exposed sanitary <br />sevaer effluent constitutes a true emergency that will only be <br />exacerbated by the necessity of the time required for the competitive <br />bidding process; and <br />WHEREAS, the Mayor and Council, based upon the recommenda- <br />tions of the Building Commissioner and Village Engineer, have <br />determined that the price quotation provided by ARI Construction <br />Company is fair, just and equitable; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MP,YFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Director of Finance are hereby <br />authorized and directed to enter into a contract with ARI Construction <br />Company in an amount not to exceed Ten Thousand Three Hundred Sixty <br />Four pollars ($10,364.00) for the construction of certain drain <br />improvements on Woodlane Drive in order to alleviate the flow of above <br />ground sanitary sewer effluent. <br />Section 2. The contract authorized herein is hereby <br />declared to be a true emergency for the reasons set forth hereinabove <br />and, accordinglyo for those reasons, this contract is authorized <br />without the necessity of competitive bidding.
