RESOLUTION N0. 83- 22 <br />INTRODUCED BY: Mayor Beebe & Council as a Whole <br />A RESOLUTION DECLARING THE INTENT <br />OF THE COUNCIL OF MAYF'IELD VILLAGE <br />TO ACCEPT FOR DEDICATION CERTAIN <br />STREETS WITHIN AINTREE NORTH <br />DEVELOPMENT, PHASE II, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Ordinance No. 80-70, duly enacted by <br />the Council of Mayfield Village on December 15, 1980, Council of <br />Mayfield Village accepted the plat submitted by the Aintree North <br />Development Company, the owner of Aintree North Development, Phase II, <br />for recording purposes only; and <br />WHEREAS, it is the intent of this Council, after all <br />improvements have been installed within the streets within the said <br />Subdivision and approved by the Engineer, to accept said Subdivision <br />for dedication in accordance with the Codified Ordinances of Mayfield <br />Village, Ohio; and <br />WHEREAS, as a prerequisite for obtaining permits from the <br />City of Cleveland to install water mains within the said streets of <br />the Subdivision, the City of Cleveland requires a Resolution of Intent <br />from the Village before giving such permit; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT; <br />Section 1. The Council of Mayfield Village does hereby <br />express its intent to accept for dedication the streets shown on the <br />Subdivision plat of Aintree North Development, Phase II, after all <br />improvements, including utilities,~have been installed and approved by <br />the Engineer of Mayfield Village, said acceptance to be in accordance <br />with the Codified Ordinances of Mayfield Village, Ohio. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to send a copy of this Resolution to the City of Cleveland, <br />Department of Public Utilities, Division of Water. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4 This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that it is immediately necessary to assure proper <br />
