f <br />RESOLUTION N0. 824 <br />INTRODUCED BY: Mr. Boger <br />A RESOLUTION TO THE GENERAL ASSEMBLY OF THE STATE OF OHIO i <br />REQUESTING THAT SECTION 4303.261 OF THE OHIO <br />REVISED CODE, RELATIVE TO LOCAL GOVERNMENT <br />OBJECTIONS.TO LIQUOR PERMIT APPLICATIONS BE <br />AMENDED TO REQUIRE THE HEARINGS ON LOCAL <br />GOVERNMENT OBJECTIONS BE HELD IN THE COUNTY <br />WHEREIN THE PERMIT PREMISES ARE TO BE LOCATED <br />WHEREAS, Section 4303.261 provides that hearings on local govern- <br />ment objections be held at the offices of the Department of Liquor <br />Control in Columbus, and <br />' WHEREAS, tliissrequirement places upon local governments an <br />unreasonable burden in sustaining the necessmry evidentiarq burdens of <br />proof to sustain their objections to liquox permit a'pplications, and <br />WHEREAS, is is most difficult for local governments to get witnesses <br />to appear in Columbus because of the obvious problems of logistics and <br />burdens of employment, and <br />WHEREAS, it would appear most unfair that the applicant himself <br />need not be present at the hearing, when a specified member of the local <br />government must be present with other witnesses to sustain the local <br />government's burden of proof. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of <br />Mayfield, State of Ohio, thatt <br />SECTION 1. The Council of the Village of Mayfield implores the <br />General Assemblq to amend Section 4303.261 of the Ohio Revised Code <br />relating to local government objections to permit applications be amended <br />to make it mandatorq that the hearings of local government objections to <br />liquor permit applications pursuant to Section 4303.261 be held in the <br />county wherein the proposed permit premises is situated. <br />BE IT FURTHER RESOLVED that the Clerk of Council transmit a certified <br />copy of this Resolutioa to the Clerk of the Ohio Senate and the Clerk <br />of the Ohio House of Representatives. <br />Adopted this 18th day of September, 1972. <br />ATTEST: <br />(SL) CLERK-TREASURER ZSiDEN`P-6F-COUNCiL
