ORDINANCE NO. 85-10 <br />INTRODUCED BY: Mayor Carmen & Council <br />AN ORDINANCE DECLARING THE COMMIT- <br />MENT OF MAYFIELD VILLAGE TO PARTI- <br />CIPATE WITH THE DIRECTOR OF TRANS- <br />PORTAT ION AND TH E NORTH EAS T OH IO <br />AREAWIDE COORDINATING AGENCY FOR <br />THE CONSTRUCTION OF A BIKE PATH ON <br />STATE ROUTE 91 AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />have determined that it is in the best interests of the health, safety <br />and welfare of the residents of Mayfield Village that there be <br />constructed a ten foot wide bike path from Sandalwood Drive to the <br />entrance of the Cleveland Metropolitan Park on the east side of State <br />Route 91; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF NIAYFIELD VILLP,GE, OHIOo THAT: <br />Section l. It is hereby declared to be in the public <br />interest that the consent of Mayfield Village be and is hereby given <br />to the Director of Transportation to construct the above-described <br />improvement in accordance with the plans, specifications, and <br />estimates as approved by the said Director of Transportation. <br />Section 2. Mayfield Village hereby proposes to cooperate <br />with the State of Ohio in the costs of the above-described improvement <br />as follows: <br />(a) Assume and contribute the entire cost and expense <br />of the improvement less the amount of Federal Aid, Special <br />Bikeway Funds, set aside by the Director of Transportation <br />and the Northeast Ohio Areawide Coordinating Agency (1VOACA) <br />for the financing of this improvement from funds allocated <br />by the Federal Highway Administration, U.S. Department of <br />Transportation. <br />(b) Assume and bear one hunclred percent (100%) of the <br />costs of preliminary engineering and right-of-way. <br />Section 3. The Mayor and Director of Finance are hereby <br />authorized and directed to enter into agreements with the Director of <br />Transportation necessary to complete the planning and construction of <br />the af orementioned improvement. <br />Section 4. Upon completion of said improvement Mayfield <br />Village agrees to keep the bike path open to bicycle traffic at all <br />times and to maintain the improvement in accordance with the provi- <br />sions of the statutes relating thereto and to make ample financial and <br />other provisions f or such maintenance.
