,/ o <br />ORDINANCE NO. 73- 10 <br />INTRODUCED BY: Councilman Lawrence Flynn <br />AN ORDINANCE PROPOSING AN AMENDMEPdT IN THE <br />MUNICIPAL CHARTER AVD PROVIDING FOR SUBP4ISSION <br />OF THE QUESTION TO THE ELECTORATE. <br />? isr <br />i? <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The question of the amendment of Article III, <br />Section 7 of the Charter of Mayfield Village, Ohio, adopted on P4ay <br />7, 1974, be submitted to the electorate of the municipality so that, <br />as amended, the same shall read as follows: <br />"Section 7. SALARISS, BONDS AND COMPENSATION. <br />(a) The-Council sha11 have the pot•rer to fix all compensa- <br />tion paid by the municipality and the salary of its own members, <br />except as otherwise provided in this Charter. Any person may <br />be required by the Council, from time to time, to furnish a <br />bond for the faithful performance of that person's duties and <br />the Council shall provide that the premium for such bond be <br />paid by the municipality. The compensation of the Mayor, the <br />Finance Director and each member of Council shall be fixed at <br />least thirty (30) days prior to the last date on which nomina- <br />tion pe?Eitioas for the next following full term of Council may <br />be filed with the Board of Elections of Cuyahoga County, Ohio. <br />Such compensation, when so-fixed, shall become effective on <br />the first day of January of the following year. Each member <br />of Council shall be compensated equally, both newly elected <br />members and those serving the balance of a term. During the <br />ensuing two (2) year term of Cour.cil, the compensation of the <br />h4ayor, Finance Director and members of Council shall not be <br />diminished or increased, and thereafter may be changed only <br />according to the terms ef this Section. <br />(b) The Council shall fix the salaries of all elective <br />and appointive officials. The Council, or the D4ayor with the <br />concurrence of the Finance Director, may authorize the payment <br />or reimbursement of exPenses incurred by any official, employee <br />or member of any board or commission of the municipality for <br />travel or otherwise in the interest of the municipality, except <br />that any such expense concurred by the Mayor or the Finance <br />Director must be approved by the Council." <br />Section 2. The question of the amendnent of the Charter <br />as set forth in Section 1 shall be submitted to a vote of the qualified <br />electors of the municipality at the regularly scheduled primary elec- <br />tion to be held in Mayfield Village on June 6, 1978, but, if for any <br />reason said election is not held on said date, then the question- <br />shall be submitted to a vote of the qualified electors at the general <br />election to be held Dlavember 7, 1978. <br />Section 3. The question to be presented to the electors <br />shall be stated on the ballot as: <br />"Shall Article III, Section 7 of the Charter of P4ayPield <br />Village, Ohio, be amended to provide that the compensation of <br />each member of Council shall at all times be equal to every <br />other member of Ccuncil.:," <br />? <br />If paper ballots are used, a space on such ballot, immediately fo1- <br />locving the question, shall be provided for the voter to indicate <br />"for the amendment" or "against the amendment". If voting machines <br />are used, the machine shall state the question and shall provide <br />for the machine recordation of a vote with either the words "for <br />;he amendment" or "yes", or, in the alternative, "against the amend- <br />ment" or "no".
