NO. 78-25 <br />BY: Mayor Beebe <br />AN EMERGENCY ORDINANCE REPEALING ORDINANCE 75-37 <br />AND AUTHORIZING THE DIRECTOR OF LAW TO SERVE AS <br />LEGAL COUNSEL FOR THE CIVIL SERVICE COMMISSION. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Ordinance 75-37, authorizing separate and <br />special counsel for the Civil Service Commission is repealed effec- <br />tive immediately. <br />Section 2. Pursuant to his contract with the municipality, <br />the Law Director is authorized and directed to serve as legal counsel <br />to the Civil Service Commission for all purposes in which such repre- <br />sentation is legal. In the event that the Law Director finds a con- <br />flict of interest or otherwise feels that special counsel is necessary, <br />he shall report such fact to the Council along with his recommenda- <br />tions for the appointment of special counsel and special counsel shall <br />thereafter be appointed and paid upon passage by a motion by a simple <br />majority of Council. <br />Section 3. This ordinance is an emergency measure i.mmediately <br />necessary for the preservation of the peace, health and safety of the <br />residents of Mayfield Village in that it provides for orderly govern- <br />mental £unction without excessive cost.
