ORDINANCE N0. 71- 1 <br />BY: MR. Bordonaro <br />AN EMERGENCY ORDINANCE TO PROVIDE FOR WRITTEN NOTICE <br />OF WITHDRAWAL FROM THE AGREEMENT FOR CENTRAL COLLECTION <br />OF MUNICIPAL INCOME TAXES BETWEEN THIS MUNICIPALITY <br />AND, THE CITY OF CLEVELAND AND OTHERS. <br />WHEREAS, this municipality previously entered into an agreement with the <br />City of Cleveland and other municipalities whereby the City of Cleveland Division <br />of Taxation functions as a Central Collection Agency for municipal income taxes <br />levied by the participants to the agreement; and <br />WE[EREAS, Article IX, Paragraph A of such agreement provides, in part, <br />"any participant may withdraw from this agreement for the <br />operation of a Central Collection Agency provided, however, <br />that any such withdrawal shall be effective only on <br />December 31 of any given year and shall be preceded by <br />written notice of withdrawal via registered mail and <br />return receipt, received by the Agency Administrator no <br />later than February 20 prior to the effective date of <br />such withdrawal." and <br />tJHEREAS, due to the announced intention of the City of Cleveland to <br />cancel tax reciprocity, this community must amend its income tax ordinance in <br />a manner inconsistent with the agreement for Central Collection; <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, Ohio, that: <br />Section 1. The Village of Mayfield withdraws from such agreement <br />effective December 31, 1971. <br />Section 2. The Clerk-Treasurer is authorized and directed to give <br />notice of such withdrawal in writing along with a certified copy of this Ordinance <br />to Pir. Louis V. Corsi, Administrator of the Central Collection Agency, <br />1701 Lakeside Avenue, N.E., Cleveland, Ohio 44114, by registered mail, return <br />receipt requested, prior to February 15, 1971. <br />Section 3. This Ordinance is an emergency measure necessary to preserve <br />the public peace, health, safety and welfare in that failure to revise the municipal <br />income tax ordinance as stated in the preamble will result in a shortage of funds <br />necessary to continue the normal operation of this municipality.
