ORDINANCE No. t~72 - 195l~ By Mr. Endres AN EMERGENCY ORDINANCE AMENDING ORDINANCE N0. l~70 SECTION 1, PASSED JULY 12, 1954® .. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIh~LD, STATE OF OHIO; THAT: Sec. 1. It is hereby determined by this Council that the estimating Board appointed pursuant to Resolution 218-1953 adopted I~ay 18, 1953, in its estimate of .the property owners cost and expense of improving S.O.M. Center Road from the center line of liTilson MiLZs Road to the south corpor- ation line of Mayfield Village by the installation of a water main therein, used in the allocation of said cost and .expense the Village Engineer's tabulation of each property's ]a.neal feet frontage - a total of 3,790.64 lineal feet which said tabulation was 20 lineal feet in error re parcel Auditor's No. 831-37-5 listed in said Engineer's tabulation report as 180 lineal feet front when the CountyAuditor's record for said property is actually 160 lineal feet front; and said estimating Board's report to Council dated May 15, 1954 listed said property No. 831-37-5 as 180 lineal feet front when said report should have listed 160 lineal feet front and said estimating Board in said report to Council listed the assessment for said property No. 831-37-5 as fi;~1,272.46 based on 180 lineal feet when it was only 160 lineal feet and listed the total property assessment as X26,796.76, which amount was assessed by Ordinance No. 470-1954. Sec. 2, It is hereby determined by Council that Section 1 of Ordinance o. 70-1954, passed July 12, 195-, is hereby amended to read as follows: "Sec. 1. That the assessment of the cost and expense of improving 5.0.?t+I. Center Road from the center line of 1`~filson Mi11s Road in a Southerly direction to the South corporation line of Mayfield Village by the installation of a water main and appurtenances therein, amounting in the aggregate to X26,655.37 being X141.39 less than the amount of ~26,796.7b reported to this Council on the lsth day of May, 1954, by the Board heretofore appointed to estimate said assessments, notice of the filing of said assessments has been given as required by la~nr, be and the same is hereby adopted and confirmed, and that there is hereby levied and assessed upon the lots ~ d lands bounding and abutting upon said improvement the several amounts reported as aforesaid, with the exception that the assessment levied against the Elsie Sloan property Auditor's No. 831-37-5 shall be X1,131.07 instead of X1,272.46 reported by said Board, which assessments together vuith the descriptions of said lots and lands are now on file in the office of the Clerk of this Council, and vrhich assessments are in proportion to the special benefits and are not in excess of the special benefits to said properties, and are not in excess of any statutory limitation."
