SOLD BEFORE THE.=FILING OF THE FTNAL PLAN, AND THE , CONSTRUGTION.OF TEMPORARY PAVEM~IT. _ , WHEREASg Kenwood Builders Inc,,.,. has requested permission to:eonstruct'. two model houses on Sublots.Nos~ 15 and 16 on Walnut Drive in the Elsena Acres Subdivision Nom 1, and WHEREAS, although all-underground improvements have been constructed in said proposed streets no;pavement has been installed nor has the final plan of said subdivision been filed for record; and _ WHEREA.S~ Kenwood Buildersi Inca has represented that# at its present rate of construction;said pavement should be completed at least two months before said two model houses are completedi even if construction on the latter is begun immediatelys and has further represented that if the - construction of said model houses is delayed until after the road is f inished~ the model houses could not be completed before late Fall of 1962$ and this would delay subsequent construction of houses in the~,subdivision for one full years at an interest penalty of approximately $15,00000; and WHEREASy Kenwood_ Builders Incx:,y . is willing to agree,,. on behalf of itself and. the owner of the land on which said model b.ouses will be constructeds that said houses will not be sold until the final plan of the subdivision is filed for record and at least the temporary pavement is installedp and WHEREAS acting under Section 9 of Ordinance Noy, 468 y. it is the opinion of.Couneil that a variance should be granted as requested in order to relieve the said Kenwood Buildersf Inch of a hardship$ cad the granting of such variance would not injury other property or its owners~a and WHE$E.E1S~ the Planning & Zoning Commission has approved the said. request of Kenwood Builders, Inca e NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF ~AYFIELD3.CUYAHOGA_COUNTY~ OHIO*,, THAT: .
