RESOLUTION No0 544 By rir. Sloan A RESOLUTION TO REFUND CERTAIN SPECIAL ASSESSMENTS ERRONEQUSI,Y PAID. -. WHEREAS, Sublot No. 17 on Ivietro Park Drive was erroneously assessed by the County Auditor for construction of water mains on SOPI Center Road, even though said sublot did not abut the said improvement and was in no way benef ited, and even though the Board of Assessors did not assess said sublot for the cost of said improvement; and 't+IHEREAS, George Aa Zorn and Helen Zorn, the former owners of said Sublot, have paid the erroneous assessment on said sublot for several years; and WHEREAS, said George A. Zorn and Helen Zorn have sold said sublot and the Escrow Agent is withholding out of, the proceeds of sale the sum of $350.00 for assessments still unpaid on said sublot for said improvement; and WHEREAS, it is proposed that George A. Zorn and Helen Zorn authorize payment of. said sum of $350.00 to the County Tre~surer~~; that the Village then refund said sum of .money, when received from the County ; and WHEREAS, said George ,A. Zorn and Helen Zorn waive any claim for assessments paid by them prior to the time of the sale of-said property, NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA_COUNTY OHIO, T~IA,T: - - - Sec. 1. Upon proof that the said sum of $350.OO~a now being held in escrow, has Ueen paid to the County Treasurer for unpaid assessments erroneously levied on Sublot No, 17 on Metro Park Drive, and upon receipt of said sum of money by the Village of Ltiiayfield, the Clerk and the Treasurer of the Village are hereby authorized and directed to refund said,~sum of $350A00 out of the special assessment bond retirement fund to George A. Zorn.and Helen Zorn. Sec. 2. This Resolution shall_.be in force and effect the earliest ~- period permitted by law. Adopted this 13th day of July, 1962® Attest: I~iayor .. President of Council u
