ORDINANCE N0. 85- 2 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole. <br />AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE N0. 84-39, <br />PASSED AUGUST'24, 1984, ENTITLED "AN ORDINANCE LEVYING <br />ASSESSMENTS FOR THE IMPROVEMENT OF BEECH HILL ROAD BY HAV- <br />ING IT RECONSTRUCTED AND REPAVED, AND DECLARING AN EMERGEN- <br />CY," AND DECLARING AN EMERGENCY. <br />WHEREAS, Council heretofore by Ordinance No. 84-39, passed August 24, <br />1984, levied special assessments to pay a portion of the cost of the improve- <br />ment therein described; and <br />WHEREAS, through inadvertence, the aggregate amount of assessments <br />that had been filed prior to the passage of Ordinance No. 84-39 was incorrect- <br />ly set forth in Section 1 of that ordinance; and <br />WHEREAS, the assessments shown on the list of special assessments <br />presently on file in the office of the Clerk of Council9 which list was <br />adopted and confirmed by Ordinance Noe 84-39, aggregate in the amount set <br />forth herein and it is Council's desire to correct the records of the Village <br />_ by amending such legislation as herein provided; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Cuyahoga County, State of Ohio, that: <br />Section 1. Existing Section 1 of Ordinance No. 84-39, passed August <br />24, 1984, be and the same is hereby amended to read as follows: <br />"Section 1. The adjusted assessment of the cost of <br />the improvement of Beech Hill Road in Mayfield Village, <br />Ohio, by having it reconstructed and repaved, as heretofore <br />reported to this Council and now on file in the office of <br />its Clerk, amounting in the aggregate to $72,808.09 is <br />hereby adopted and confirmed." <br />Section 2. Council finds and determines that the period for receiv- <br />ing payment of such assessments in cash shall not be extended by reason of the <br />amendment herein made. <br />Section 3. The Clerk of Council is hereby directed to deliver a <br />certified copy of this ordinance to the County Auditor within 20 days after <br />its passage. <br />Section 4. Section 1 of Ordinance No. 84-39 as it was passed on <br />August 24, 1984, be and the same is hereby repealed. <br />Section 5. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were
