<br />This agreement, entered into this day of October, 1964, at
<br />Mayfield Heights, Ohio, by and betcaeen the City of Mayfield Heights, by its
<br />,Mayor and Clerk of Council, who have beeh duly authorized to execute said
<br />agreement by Ordinance No. , adopted by the Coancil of said city on
<br />the 12th day of October, 1964, hereinafter referred to sometimes as the
<br />"City" and the Village of Mayfield by its Mayor and Clesk, who have been
<br />duly authorized to execute said agreement by Ordinance No. 857, adopted
<br />by the Council of the Village on the 21st day of September, 1964, soinetimes
<br />hereinafter referred to as the "Village", - •
<br />WITNESSETH:
<br />WElERE,AS, Ridgebury Boulevard, between Washington Boulevard and
<br />Orchard Heights Drive in the City and Village is a duly dedicated highway
<br />running i? a generally easterly and°westerly direction, the center line of
<br />which constitutes the soutfierly corporate line of the Village and the northerly
<br />corporate boundary 'line of the City; and
<br />WNERFsAS, the Councils of said municipalities deem it necessary to.
<br />improve said Ridgebury Boulevard between the termini aforementioned by the
<br />paving, grading, draining,-and curbing of Ridgebury Boulevard together with
<br />the installation of a cast iron water main with the necessary appurtenances
<br />thereto; and
<br />WHEREAS, the laws of Ohio, and especially Secs. 715.02 and 727.41 oE
<br />the Ohio Revised Code, provide that municipal corporations may enter into
<br />agreenents for the construction,•maintenance, and operation of public
<br />improvements, benefitittg both municipal corporations and especially wherever
<br />the boundary line between two municipal corporations is located within or
<br />along the sidelines of a street, such municipal corporations may enter into
<br />an agreement Por the,improvement of such street in such manner as the
<br />respective 7egislative authorities thereof determine; and
<br />WHEREAS, the parties hereto, together with the City of 7,yttdhurst attd
<br />the Village of Highland Heights, Ohio, have hitherto entered infio an agreement
<br />with the Board of County Commissioners of Cuyahoga County, Ohio, for the ,
<br />paving of said Ridgebury Boulevard,,together with other appurtenances; andWHEREAS, the City of Mayfield Heights presently has a water line
<br />along Ridgebury BouTevard, otte segment of which is between I,ander Road and
<br />Washington Boulevard and the other between•Orchard,Heights'Drive and the
<br />easterly corporation line of May£ield Village, which serves some of the
<br />residents of Mayfield Heights; and
<br />WHEREAS, Mayfield,Village and some of its residents are desirous
<br />of utilizing the Eacilities of said water line; and =
