iZ <br />Ordinance No. 859 <br />gy Mr, Belzer <br />AN IImERGENCY ORDINANCE PROHIBITING THE C[TTTING OF ANY <br />PAVM%1ENT ALONG RIDGEBURY BOULFsVARD FOR THE PURPO$E OF <br />INSTAidSNG_WATER_OR SEGIGR.CONNECTZONS FOR A PERIOD OF <br />FIVE YEQRS AFTER THE COMPLETION 0F TH& PAVEMENT_ <br />WEIERBAS, The Board oE County Commissioners of Cuyahoga County Ohio <br />has entered into an pgreement with the Cities of I,yndhuxst and Mayfield Heights <br />and the Villages of Mayfield and Highland Heights_for the i.mprovement of <br />Ridgebury Boulevazd between Bichmond Road and SOM Center Road by the con- <br />struction of a concrete paveauent, and the portion of such installatioa lying <br />within the Village of MayEield is to be constructed in 1964 or early 1965; and <br />[+HRRFAQ, once the new pavement has been installed on Ridgebury Boulevard, <br />it will be detri.mental to both the Village and tha County to hava such pavement <br />cut £or a period of five years after its construction; and <br />WHEE2LpS, it is desirous that such rasidents be given notice of the <br />proposed improvement and furthes given the opportunity to make such insYallation <br />and conpections prior to the completion of such proposed pavement, <br />NOW THGREFORE BE IT OBDAINID BY TEM COUNCIT. OF THE VILLAGE OF MAYFIELD, <br />CUYAtIOGA COUNTYj OHIOj THATi . . , . . .._ .. . <br />Sec. 1. The Village of MayField heraby consents to the improvement of <br />RidgeburyBoulevard in the Village oE Mayfield by the installatioa of a pavemettt <br />as proposed by the plans prepared on behalf aE the County Engineer. <br />Sec. 2. pfter the date on which the installation of said pavement is <br />completed in the Village of Mayfield, it shall be unlawful to cut such pavement <br />or to make any opening therein, on Ridgebury Boulevard in the Village of Mayfield, <br />except for emergency or necessary repairs to existing utility installations, for <br />a period of five years after completion of the pavement.. <br />Sec. 3. The Clerk is hereby authorized and directed to prepare Notices <br />of the passage of this ordinance and to cause said notices to be served either <br />personally or at the residence of or by ordinary mail to the owners of properties <br />abutting said proposed improvement. In the event that aqy of the owners of said <br />properties cannot be foundt the Clesk.is hereby authorized and directed to cause <br />notice of the passage of this ordinance to be published once in a newspaper of <br />general circulation in the Village of Mayfield.
