<br />ORDIN,ANCE No. 873 <br />By Mr. Shaw <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE IIKPROVFA2INT <br />OI' RIDGEBURY BOULEVARD IN THE VILI,AGE OF MAYFIELD, OHIO, <br />BY GRADING, DRAINING,_CURBING, PAVING, AND CONSTRUCTING <br />CUP,B CONNECTIONS SiFiERE NECESSARY, TOGETHER 4TITH AI.I,_ _ <br />NECESSARY AEPURTENANCES AND DECLARING AN M7F.RGENCY <br />BE IT ORDAINED BY THE COUNCII. OF THE VIId,AGE OF MAYFIELD, OHIO, COUNTY OF <br />CUYAHOGA.AND STATE OF OHIO,.THAT: <br />Sec. 1. It is hereby determined to proceed wi.th the improvement in <br />the Village of Mayfield, Ohio, oE Ridgebury Boulevard, from the center line <br />of 7ander Road, which is the Westerly corporate line of the Village of Mayfield, <br />in an Easterly direction approximately 2825.35 feet to the Easterly corporate <br />line o£ the Village of Mayfield, by grading, draining, curbing, paving and <br />constructing curb connections where necessary, together with all necessary <br />appurtenances. <br />Sec. 2. Said improvement shall be made in accordance with the provisions <br />of Resolution No. 614, adopted September 21, 1964, and with the plans, specifi- <br />cations, estimates and profiles filed with this Council by the County Engineer <br />of Cuyahoga County and approved by the Village Engineer, by grading, draining, <br />curbing, paving and constructing curb connections where necessary, together <br />with all necessary appurtenances, said improvement being made in cooperation <br />with the Municipalities of Lyndhurst, Nayfield Heights and Highland Heights <br />and the County of Cuyahoga, in accordance with Ordinance No, 848, passed May <br />18, 1964. <br />Sec. 3. All claims for damages resulting therefrom that have been <br />legally filed shall be enquired into before the commencement of the proposed <br />improvement and the Solicitor is hereby aut-horized and directed to institute <br />legal proceedings in a court of competent jurisdiction to enquire into any <br />claims that have been so filed. <br />Sec. 4. That portion of the cost provided in the above mentioned <br />resolution oE ttecessity to be assessed shall be assessed in the manner provided <br />in said resolution on the lots and lands described there in ten annual install- <br />ments. <br />Sec. 5. The estimated assessments heretofore prepared and filed in the <br />office of the Clerk of this Council are hereby adopted. <br />Sec. 6. The Clerk of this Council is hereby directed to deliver a <br />certified copy of this ordinance to the County puditor within 15 days after <br />the date of its passage.
