MINUTES OF PUBLIC HEARING <br />APRIL 24, 1972 <br />8:15 p.m. <br />Present: President Francis J. O'Neill, Councilmen Boehmer, Giesser, Limpert, <br />Prokasy, Saringer, Speedling, West. <br />Also present: Mayor Ralph Christman, Service Director Henry Caster, City <br />Engineer Michael Karhan, Asst. City Engineer David Ransbury, Clerk <br />of Council Nora Hill. <br />Mr. West, Chairman Building, Zoning & Development Committee, opened meeting <br />stating this is a Public Hearing on Ordinance No. 72-27. A~ Ordinance amending <br />the. Zone Map adopted as .part of Ordinance No. 62-33 (known as the Zoning Code <br />of the City of North Olmsted) by changing the designation thereon of certain <br />land from the present designations thereon as Mixed Use District to General <br />Retail Business District.. <br />Mr. Giesser read ordinance in its entirety. <br />Mr. Karhan, City Engineer, outlined area on map. <br />Mr. West explained the reason this rezoning is before Council is that originally <br />these two parcels were apart of the Columbine properties which was rezoned to <br />Mixed Use. The Columbine properties were sold out to another party and they do <br />not need these two parcels of ground. These two parcels are non conforming - <br />cannot be used for Mixed Use as they do not cond~~st of ten acres, and the property <br />owner asked that they be rezoned back to commercial. <br />The Clerk read letter from John Knox Church, dated April 21, 1972. Letter cited <br />the motion passed by the Session of John Knox Church, voting on April Z0, 1972, <br />opposing the rezoning of the property at 25054 Lorain Road from Mixed Use to <br />Commercial Use, for the reason that this property would be utilized as a D-5 <br />Liquor Outlet, and listed specific objections. <br />Mrs. Kermit, Loran Road, felt a bar would be too close to the Fire Department <br />with Rescue Squad going in and out; felt it would be an accident area. <br />Rev. Gordon Blasius, Minister John Knox Church, stated the Church is aware of <br />the fact that the intended use of the property is for a H-5 liquor permit applicant, <br />and testified against this use at a hearing before the State Department of Liquor <br />Control on March 9, 1972. It is not the intention of the Session of John Knox Church <br />to hurt the property owner. The Church is concerned that this might be a place that <br />dispenses alcoholic beverages and are wondering what effect this will have on the <br />young people and church property. John Knox Church has dedicated a good bit of <br />Church use during the week to boy scout and girl scout troops. Rev. Blasius had <br />letters from the troop leaders objecting to the intended use of this property but <br />such letters were disallowed at the Hearing as valid testimony because nose of the <br />individuals who had signed the statements were present to be cross-examined. Rev. <br />Blasius explained the happenrl~,p~, at the Hearing, also that he has been notified <br />that their objections were overruled. <br /> <br />
