O'Neill, Councilmen Goggin, Limpert, Saringer, <br />Sharpe, Wilas~ky. <br />Also present: Mayor Ralph Christr~^a, LsN Director Michael Gareau, Service <br />Director Henry Caster, Clerk of Council Nora Aill. <br />Absent: Councilmen Giessen, hest. <br />Special Meeting of Council was called to order by President O'l~raill at 6:45 P.M. <br />President O'Neill stated this Spacial Meeting of Council was called to review <br />the Segal opinion rendered by the Law Dapartteent of the City of Borth OLstsd <br />regarding the appointment by Mayor Ralph Christman of Mr. 3. Howard Childs to <br />the pasitian of Acting City Engineer; and make inquiry by this Comncl into the <br />appointment by the Mayor, of Mr. J. Aoward Childs to the gositia~ of Acting <br />City Engineer. <br />This Special Meeting was c~.led by Councilmen Wilamosky, Sharpe and Swinger. <br />Mr. Wilamosky stated he had requested the Law Departsent to render a legal <br />opinion regarding the appointment by Mayor Christman of Mr. Aoo-ard Childs to <br />the position of l~ngineer. At a recent Council Meeting Mr. Childs stated he has <br />taken the eza~ituttion to becooe a registered engineer in the State of Ohio. Mr. <br />Wilamosky stated the garter sets the frasmbrork for municigal goverss~ctt and the <br />legal opinion the Law D~artment has rendered on this matter must be coesidere~l. <br />Mr. Wilamosky referred to the Charter and quoted the Preamble. <br />Mr. Wilamosky stated his feeling on this is that the Charter does stipulate the <br />head of Engineering must be registered with the State as a professional eEtginaer <br />and Mr. Childs indicated at last Council Meeting that he wan not registered; sad <br />requested to proceed into t~ legal opinion Council received fresd Lwr Director <br />Gareau and asked Law Director Gareau if he would expand oa aas+rers to questions <br />asked by Mr. Nilamc-s~Cy which are as follaw~a: a) Can the Division of En ring <br />in the City of North Olmsted be hesshed by a City Engineer that is not registered <br />as a professional engineer in the State of Ohio? <br />b) Should a person that is serving as sating City Engineer possess registration <br />in the State of Ohio as a registered professional engineer? <br />c) Is the appointment of a City Bngineer by the Mayor sub3ect to confirmation by <br />City Council2 <br />d) Can the Mayor appoint an acting City &~gineer without confirmwation of City <br />Council? <br />Law Director Gareau stated he has given his opinion vhieh is self explanatory <br />to anyone who has read it -Legal Opinion makes urogressive steps starting out <br />with Article V Section 1 whereby the Department of Public Service is erestsd. <br />When you proceed further into the Charter within the Department of Public Service <br />there is also a Division of Bnginmering, artd in Article V Section 5 - A -."The <br />Division of Engineering shall be headed by a City 8ngineer who sha21 be registered <br />as a professional engineer in the State of Ohio". <br />
