<br />I4H1Q.EAS, the developer has heretofore submiluted a plat ior the subdividing of
<br />Aspen Drive and Cypress Drive, together with i.mprovement plans, ivhich have been accepted
<br />by the City of Tlorth Olmsted for recording purposes only, now repo::,Its that the City of
<br />Cleveland jiater Department has adopted a requirenient that in said proposed subdivisions
<br />a developer is req_uired to give to the citf, wherein the development is to be made, an
<br />easement for the installation and ma,intena,nce of a water main i.n the areas depicted on
<br />the plat therein aor proposed stxeet -ourposes, and,
<br />',dH ER' , the developer has prepa,red such an easement urith3.n the aiorementioned
<br />proposed roa.ds ior the nurposes of installing and maintaining a water main, a,na,
<br />'.'JH?PZA,S, the Engineer of tne City of North Glmsted has advised Uouncil that the
<br />legal descrip'vion contained in said easement p-roperly described the proposed roads -vr=i.thin
<br />said subdivision, and,

<br />TdUW? TFIEREFORE, 13E IT 1''??GLVI'D by the Council of the City of iaorth OlrIsted, S luate
<br />of Ohio:
<br />Section l: Council hereby accepts the easement from the developer to the City
<br />of North Olrnsted 'Lor the installation of a wa,ter main in proposed As-L?en urive and Cyp--?-ess
<br />Drive in the City of ilorth Qlmsted.
<br />Section 2: 'vlheref'ore, tt?is resolution is determined to pe un emergency measure
<br />necessary fcr the irunediate preserv,:,tion of the public 'tzeU,ltlz, sGfety and welia,re ai the
<br />City of North Ulmsted, and such emergency exists Uy virtue or' the necessity of accep?in?;
<br />the easement for the insta,llation of a water main in proposed Aspen urive and Cy_rress
<br />yrive in the City of iJorth Glmsted, in conformi.ty with the requirements oi the ITater
<br />yepartment of the City of Cleveland for the installation of water mains in proposed
<br />subdivisions, plans of trhich have heretofore been approved by the city to-gether -vrith
<br />the improvement plans of the developer fox the improvements reauired by the city in
<br />proposed stree-ts indic???ted upon said streets previously approved i'or recording -;iurposes
<br />only.
<br />Section 3: Wheieiore, tnis resolution s'riall take immediate ef?ect from and after
