<br />y+=,LAS, the developer has heretofore submitted a plat for the subdividing of
<br />Evergreen Drive, Douglas Drive, 1-Jillet Road and A7.den Drive, together with improvement
<br />plans, tahich ha,ve been accepted by the City of idorth Olmsted for recording purposes
<br />onlyi now reports tha,t the City of Cleveland lJater Department has adopted a requirement
<br />that in said proposed suociivisions a developer is required to give to the city, wherein
<br />the development is to be made, an easement for the installation and maa.ntenance of a
<br />water ma„in in the areas depicted on the plat therein for proposed street purposes, and,
<br />,,aIDM , the developer has brepared such an easement ti.rithin the aforementioned
<br />proposed roads for the r?urposes of installing and maintai.nang a water main, a.n.d,
<br />jA+HLREAS, the Engi.neer oi the City of North Olmsted has advised Council that the
<br />legal description conta,ined in said easement properly described the proposed roads within
<br />said subdivision, and,
<br />1,11E?AI?.r?AS, the Solicitor approved the proposed easement as to legal form,
<br />110W? THERIMREp BE I1 R.ESOL'TLD by the Council of the City of North 0lmsted, State
<br />of Ohio,
<br />Section 1: Council hereby accepts the easement from the developer to the City
<br />of North Olmsted for the inst,-llation of a water main in proposed Lvergreen Drive, Dcuglas
<br />Drive, Willet Road and Alden Drive in the City of North Olmsted.
<br />Section 2: Vnerefore, this resolution is determined to be an emergency Measure
<br />necessary ior the immediate preservation of' the public healthi safety aa1d welfare of the
<br />City of North Glmsted, and such emergency exists oy virtue of the necessity of acceptixig-
<br />the easement for the installation of a water main in proposed Evergreen Drive, Douglas
<br />Drive, 'uTi.llet Road and Alden I7rive in tne City of IJorth Olmsted, inconform:i.ty with the
<br />recyuirements of the Water Department of the City of Cleveland ior the installation of
<br />Vrater mains in proposed subdivisions, plans of which have heretofore been apgzoved by
<br />the city together urith the improvement plans oy t'rie developer for the improvements
<br />ret}uired by the city in proposed s4reets indicated upon said streets previousl,y approved
<br />for recording purposes only.
<br />Section 3: SJhei?efore, this resolution shall take ir:unediate eflect li"rom and aiter
<br />its passa,ge, otherTlrise, at the ewrliest period allowed by law.
