<br />WHEEtE,AS., the City Engineer has heretofore been roquested to ascertain the
<br />amount of lands necessary to be acquired from Yx. & Mrs. Adolph Schier and
<br />Mr. & Mrs. Thomas J. Ijoran on 7.4hitethorn A-venue for the purpoges of ma.ki.ng the
<br />streQt sufficiently wide to conform to the other portions of the dedicated
<br />streets permitting the i.nstallation of a sidewalk therein arui straightening
<br />out the corner, and
<br />?,=,AS., the EngineQr has determinad the portions of the prezna.ses of the
<br />aforesaid individuals neaess;aicy to be acquired by the City for such purposes
<br />and prepared legal descriptions thsreof,, and
<br />WHEREAS., the City has negotiated with said property ownsrs and they have
<br />agreed to exeeute the necessary documents to convey the portion of preriises
<br />necessary for said wi.deni ng purposes.
<br />NOW., '1'HEREFME., BE I`I' O?.DAINED by the Council of the City of North QLmsted,
<br />Sta.te oi Ohio:
<br />Section 1: Tha,t the Service Director be authorized to enter inta an
<br />agresment with Mr. & Mrs. Adolph Schier and Mr. & Mrs. James Schier acquiring
<br />from them the ].ands determined necessary by the City Engineer and sufficient
<br />for the purposes of widening Whitethorn pvenus thereby permittirg a more
<br />adequate curve and providing an area for the installation of a sidewalk,
<br />and in exchange for the conveyance of said lands by the individuals hereto-
<br />fore named, the City agraes to install a sidewalk in front of said premises
<br />knawn as 26933 Whitethorn Avenue in coriformi.ty with the ordine.nces of the City,
<br />and to pay to said individuals the additional sum of One Hundred Fi.fty Dollars
<br />($150.00).
<br />Section 2: Tnat the Service D'irector be authorized to enter into an
<br />agreement with Mr. & Mrs. Thomas J. Doran to acquire from said individuals
<br />that portion of the frontage determined necessaxy by the City Engineer perrni.tting
<br />the wideni.ng of 'Whitethorn Avenue to permit the installation of a sidewalk in
<br />conformity with the ordinances of the city of North Qlmsted gnd in exehange far
<br />the said conveyance., the City agrees that the City shall ins a,Ll. a sidewalk in
<br />front of the premises of Mr. & Mrs. Thomas J. Iloran lrnown as 26947 Whitethorn
<br />Avenue in conformity with the ordinances of the City of North 07mstad without
<br />charge, and as further cornpensation for the premisss baing conveyvd to the City
<br />by said individua,ls., to lay at the tiine of the installation of said sidewalk a
<br />driveway apron,
<br />Section 3: That this ordinance is hereby detex7ained to be an emergency
<br />measure necessary for the immediate preservation of the public peace.. safety,
<br />and welfare of the City of North 0]ansted, and such emergency exi.sts by virtue
<br />of the immediate necessity of closing the acqu:i.sition of the necessary premi.ses
<br />from Mr. & Mrs. Adolph Scnier' Mr. & Mrs. James Schier., and Mr. & Mrs. Thomas J.
<br />Doran., necessary fc3r the widenirg of Whhitethorn Avenue permi.tting the straighteni.ng
<br />of the curve, paving a portion thereof and the instal:!ation of a sidewa7.k. The
<br />nsgoti.ation for the acquisition of said necessary lands have been completed.
<br />Section 4: 74erefore, this ordinance shall take immediate effect from and
<br />after its passage, otherwis?,, at the earliest period a1lowed by law.
