<br />AND DECLARING AR? MIERGENCY
<br />WHI?,'ftEA,S, the Plat of N. F. Molnar, Inc. for Gessner Estates 5ubdisrision
<br />indicating the development of Theresa Lane has heretofore been given tentative
<br />approval for recording purposes only by the Council of this City, and permitti.ng
<br />the developer to make installation of improvements in the lands shown theraon
<br />for street pm:poses, in accordance with the ordinances and resolutions of this
<br />Gity., and
<br />WFIFR.EAS., it has been reported to Council that the improveinents for street
<br />purposes havs been completed, and though not in conformitp with the ordi..nanaes
<br />of the City., and
<br />?'„EAS., said failure to make said inprovemsnts in accordance with tne
<br />ordinanees of this City ha.s been negotiated and adjusted as satisfactorily as
<br />possible and the improvements brought vp to the requ3rements of the ordinances
<br />of this Gity, in the most suitabl.e manner possibls considering the condition
<br />of said improvements as left by the devaloperq and Couaeil., havi.ng determined
<br />that the paving of the strAet and the culdesac (whieh has a mu.ch sm,aller radii
<br />than required), has besn inproved and the regidents owning propertg abutting
<br />Theresa Lane in said Subd.ivision agreeing that sai.d improvements have been
<br />material.ly eorrected to approach the standard required by the ord3.nances.
<br />NO'nT. TMMFORE., BF IT {aR.DAINED hy the Council of the City o£ North Olmsted,
<br />State of Qhio:
<br />Section l: That the Plat of N. F. Malnar, Inc.,? Gessner E$tates Subdivisiony
<br />addition to said City' be the same as approved and accepted, and that the dedication
<br />for public use of said streets and al.leys as shawn upon their platp be and the sau?e
<br />are hereby aecepted and confirmed.
<br />Section 2: That t,his ordinance is hereby determined to be an emergency
<br />measure mcessary for the immediate preservation of the public healthi safety
<br />and welfare of the City of North 07msted., and such emergency exists by virtus
<br />of the necessity of adjusting the eost of corrections to the proposed inprove-
<br />ments of the sa.id Subdivision as sr.own on the plat and imp: avement p].ans so as
<br />to bring said improvement to as near the standard as possible established by the
<br />ordinances and resolutions of this City., and, having so determ:i.ned that the
<br />improvements have been corrected as nearly as passible to so eonform to the
<br />ordinances and resolutions of this City, cont,ro7.ling the installation af improva-
<br />ments i.n a subdivi.sion, and having effected this result, to perma.t the prompt
<br />payment of expenditures made by the City to so bring Theresa I.ane, a s-treet in
<br />said plat., u.p to the requirements established by Council for this Subdivision.
