CITY OF NORTH OLMSTED <br />RESOLU"~`It~N No. 62 - /~ <br /> ~~ <br />By <br />~ <br /> <br />RESOLUTION DECLARING I'I' NECESSARY TO IMPROVE <br />WALTER ROAD FRONT A POINT NEAR THE INTERSECTION <br />OF WALTER ROAD AND BEECHLANE NORTHERLY TO THE <br />PRESENT TERMINUS OF THE WATER MAIN IN WAL'~~ER <br />ROAD IN Ti{E CITY OF WESTLAKE BY INSTALLING <br />THEREIN A WATER LINE, AND DECLARING AN EMERGENCY. <br />WHEREAS, the owners of more than sixty per cent <br />C 60%) of the front footage of property on Walter Road in the <br />City of North Olmsted from a point at the intersection of Walter <br />Road and Beechlane northerly to the northerly City limits <br />petitioned in writing for the improvement of said street by <br />constructing and installing therein a water line and in said <br />petition agreed to be assessed one-half C1/2) of the entire <br />cost of said water line which will extend approximately nine <br />hundred (900) feet northerly along Walter Road beyond the <br />corporate limits of the City of North Olmsted and into the <br />corporate limits of the City of Westlake in order to permit <br />a connection to be made with an existing water line on Walter <br />Road in the City of Westlake; and <br />WHEREAS, the Engineer of the City of North <br />Olmsted has certified to the validity of the signatures on said <br />petition as representing the owners of more than sixty per cent <br />(60%) of the front footage of property abutting on said improve- <br />ment for the portion thereof which lies within the corporate <br />limits of the City of North Olmsted; and <br />WHEREAS, the City of Westlake has by its <br />Ordinance No. 1961-112 enacted December 7, 1961, consented to <br />the construction and installation which lies within the corporate <br />limits of the City of Westlake providing that the City of ~TOrth <br />Olmsted presently assume the full cost and expense of the installa- <br />tion of said water main and appurtenances thereto as to any land <br />owners in the City of t~Hestlake, and with the further provision <br />that in future years if land owners in the City of Westlake <br />request "tap-in" rights on this water main the same will be assessed <br />on a benefit basis according to the same formula of assessment <br />as will be applied to North Olmsted land owners benefited by said <br />water main and appurtenances thereto, and providing further that <br />the City Engineer of the City of Westlake be allowed to inspect <br />and approve all engineering plans for said water main and appur- <br />tenances thereto and that a performance bond be required to guarantee <br />the return of Walter Road to its normal condition after the afore- <br />mentioned install.ati.on. <br />NOW, THEHZEFJRE, 43F IT RESOLVED by the Council <br />of ~~he City -of North Olmsted, Ohio: <br />Section 1: That it is necessary and conducive <br />to the public health., convenience and welfare to install and <br />construct a water line and appurtenances thereto on Walter Road <br />in the City of North Olmsted, Ohio, and on Walter Road in a <br />portion of Walter Road which lies within the corporate limits of <br />the City of 'Nestlake, Ohio, as shown on the plans prepared by <br />the Engineer of this City for such improvement, reference to <br />which plans .i~~ hereby made. <br /> <br />
