CITY OF NORTH OLMSTED ORDINAVCE N0. 62 - / y AN ORDTNANCE AUTHORISING THE HIRING OF A REAL ESTATE APPRAISER TO ESTABLISH VALUES FOR USE IN NEGOTIATION 0R APPROPRIATION PROCEEDINGS IN CONNECTION WITH THE ACQUISITION OF EASEMENTS ON T)OVER ROAD IN ORDER TO CONTINUE THE INSTAL- LATION OF SANITARY SEWERS ON LAVER ROAD UNDER CONTRACT 9 AND DECLARING AN EMERGENCY. WHEREAS, the installation of sanitaxy sewers on Dover Road requires the acquisition of easements; and WHEREAS, certain of the abutting property owners have given to the City of North Olmsted easements as required by the plans and specifications but certain other abutting property owners have requested that they be compensated for such easements; and WHEREAS, all of the abutting property owners were told that they would all be compensated on a fair and con- sistent basis for their easements,~Council has determined that it will be necessary to hire the services of a real estate appraiser to set the values for the easements to assist in negotiating the acquisition of easements from the abutting property owners and also to determine the value of those ease- ments heretofore given to the City of North Olmsted, Ohio; and WHEREA5~ the establishment of a fair and equitable value will be necessary in case appropriation pro- ceedings have to be filed. NOW , THEREFORE , BE I T ORDAINED EI Y TFi E COU ~1C I L OF THE CITY OF NORTH OT:.MSTED, OHIO: Section 1: That the Service Director is hereby authorized to hire an expert real estate appraiser to determine the compensation to be paid for easements as required by the plans and specifications for the installation of sanitary sewers on Dover Road under Contract No. 9 of the program for in- stallation of sanitary sewers in the City of North Olmsted, Ohio. Section 2: That the Service Director is hereby authorized to negotiate with the abutting property owners on Dover Road for the acquisition of easements as above set forth and in connection with said negotiations to be guided by the values as determined by said appraiser. Section 3: Wherefore, this ordinance is hereby de- clared to be an emergency measure necessary for the preservation of public peace, health and welfare of the City of North vlmsted, Ohio, and that such emergency exists by virtue of the necessity of going forward promptly with the construction of sanitary sewers.
