CITY OF NORTH OLM/STED~/ <br />RESOLUTION N0, b ~ - D <br />4a-~ <br />By Mr. <br />A RESOLUTION GRANTING A NINBTY DAY EXTENSION <br />OF THE COMPLETION DATE OF A CONTRACT BETWEEN <br />THE CITY OF NORTH OLMSTED AND THE NARDI CON- <br />TRACTING COMPANY, INC., AND QUAKER ENGINEERING <br />SUPPLY FOR WORK INSTALLING SEWERS - FURTHER <br />DESIGNATED AS CONTRACT NO. 4 WHICH PRESENTLY <br />EXPIRES ON JANUARY 6, 1962, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, there presently exists a contract <br />between the City of North Olmsted and The Nardi Contracting <br />Company, Inc. and Quaker Engineering Supply designated as Con- <br />tract No. 4 providing for certain work in connection with the <br />installation of sewers and providing for a completion date of <br />January 6, 1962; and <br />VOHEREAS, the said companies, The Nardi Con- <br />tracting 9Company, Inc. and Quaker Engineering Supply, have <br />been prevented from completing the contract because of unavoid- <br />able delays due to inclement weather; and <br />WHEREAS, the Service Director of the City of <br />North Olmsted 15 of the opinion that an extension of ninety <br />days in the completion date would be beneficial to the interests <br />of the City of North Olmsted because it would permit grading and i, <br />seeding as final steps in the completion of the contract at a <br />more seasonable time of the year. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL <br />OF THE CITY OF NORTH OLMS`TED, STATE OF OHIO: <br />Section 1: That an extension of ninety days from <br />the present completion date to April 6, 1962, of a contract <br />between the City of North Olmsted and The Nardi Contracting <br />Company, Inc. and Quaker Engineering Supply for the inst~.llation <br />of sewers designated as Contract No. 4 be and the same is hereby <br />granted. <br />Section 2; That this resolution is hereby declared <br />to be an emergency measure by virtue of the imminence of the <br />present completion date and because delay in the passage of <br />this resolution would raise serious legal questions of the rights <br />of all parties to said contract. <br />
