CITY OF NORTH OLMSTED ORDINANCE NO. 69-S6 BY AIV ORDINANCE ESTABLISHING RATES TO BE CHARGED FOR THE SERVICES OF THE MUNICIPAL SANITARY SEWERAGE SYSTEM UTILITY OF THE CITY OF NORTH OLMSTED, AND REPEALING ORDINANCE NOS. 67-185, ENACTED JUNE 26, 1967, 61-156, ENACTED AUGUST 15, 1961, 61-110, EIVACTED MAY 16, 1961, AND 3159, ENACTED NOVEMBER 15, 1960, AND AND DECLARING AN EMERGENCY ? WHEREAS, Council of the City of North Olmsted has heretofore determined to construct, and the City is now in process of constructing , a sewerage system and sewage treatment works and has determined to operate , the same, together with all additions thereto hereafter made or acquired by the City ( hereinafter generally called the " System as a public utility ; and WHEREAS, by Ordinance No. 2867 Council established certain rates and ch,arges for the service provided by the System and has now determined and found it necessary to rev,ise such rates so as to assure sewer revenues at least sufficient to meet the cost of operating and maintaining the System and also debt charges, reserve and other requirements of its mortgage revenue bonds heretofore authorized and sold for the purpose of financing part of the cost of ' constructing the System, for which purpose this ordinance shall supersede Ordinance No. 67-185, Ordinance No. 61-156, Ordinance IVo. 61-110, and Ordinance No. 3159. WHEREAS, to facilitate the proper billing and collection of such charges with respect to properties now or hereafter served by the waterworks system of the city of Cleveland, Council proposes to authorize the Cleveland Water DePartment to handle such billing along with its billing for water supplied by it ; and WHEREAS, to protect the health of the City and its inhabitants Council has enacted Ordinance No. 3158 requirinq all properties within the City producing sanitary sewage to connect with and use the System immediately upon its becoming available therefor. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That it is hereby determined and declared to be necessary for the due protection of the public peace, safety, health and welfare of the .' City of North Olmsted to establish and collect charges for the use of the System upon all lots, lands and premises served by or having connec,tion with the System. Section 2. That the funds received from the collection of the rates Q and charges hereinafter provided shall be paid over as received to the Director of Finance, who shall keep the same in a separate fund designed " Sewer Revenue Fund ." Subject to the provisions of any ordinance or indenture of mortgage authorizing the issuance of and securing mortgage revenue bonds for the System, monies, in said Fund shall be used for the payment of the cost and expense of operation, maintenance, repair and management of the System and any surplus in said Fund over and above the requirements herein- before mentioned may be used for payment of debt charges on bonds issued for construction of the System and for enlargements of and replacements 1n the System and parts thereof.
