F3 <br />E1N ORDINANCL LEVYITdG SPLCIAL ASSFSSMENTS FOR THE IMPROVEP/iENT <br />OF GREAT NORTHERN BOULLVARD IN THF, CITY OF NORTIi OLb'bSTED, <br />OHIO, BPT4?IE'L'Td CERTAIN TER4CNI BY INSTALLITdG STOR4 AND SANITARY <br />SETHERS AND jdATER MAIN, SEYIER AND 41ATER CURB CONNECTIONS, TO- <br />GETHER Te1ITH AI,L i'CESSARY APPURTENANCES, AND DECLARING AN <br />IIMERGENCY. <br />Ohio: <br />BE IT ORDAINED by the Council of the City of TJorth Olmsted, Cuyahoga Count-y, <br />Section l. That the revised assessment of the cost and expense of improving <br />Great Northern Boulevard from Lorain Road to Broakpark Road by installing storm <br />and sanitary sewers and water main, sewer and water curb connections, toFether <br />with all necessary appurtenances, amcunting in the aggregate to ?,104,492.41, as <br />reported to this Council on the 7th day of J'anuary, 1969, by the Engineer of <br />'chis City and now on file in the office of the Clerk of Council, be and the same <br />is hereby adopted and confirmed and that there be and are hereby levied and <br />assessed upon the lots arid lands bounding and abutting upon said improvement <br />the several amounts reparted as aforesaid, which assessments are in proportion <br />to the special benefits and are not in excess of any statutory limitation. <br />Section 2. That this Council hereby finds and determines tha,t the revised <br />assessments as novr on file in the office of said Clerk are in the same proportion <br />to the estimated assessments as originally filed as the actual cost of tne r?bove <br />described improvement is to the estima.ted cost of the improvement as originally <br />filed. <br />Section 3. That the assessment against each 1ot or parcel of land shall be <br />payable in cash within thirty days after the passage of this ardinance or at the <br />option of the owner in forty semi-annual installments with interest at the same <br />rate as shall be borne by the bonds to be issued in anticipation of the collection <br />of the same. A11 cash payments shall be made to the Director of Fznance of this <br />City. All assessments and installments thereof remaining unpaid at the expira- <br />tion of said thirty daya shall be certified by the Clerk of Council to the County <br />Auditor as provided by la,tia to be placed by him on the tax duplicate and collected <br />as otizer taxes are collected. <br />Section 4. That the Clerk of Council shall cause a notice of the passage of <br />this ordinance to be published once in a newspaper of general ci.rculation in this <br />City and to continue on file in his o:ffice said revised assessments. <br />Section 5. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its passa.ge. <br />Section 6. This ordinance is hereby declared to be an emergency measure <br />necessary :for the immediate preservation of the piiblic peace, health and safety <br />of said City and for the furtYzer reason that the immediate levy of such assess- <br />ments is necessary to permit the issuance of bonds to provide funds to retire <br />an outstanding note and thereby protect the credit of the City; wherefore, this <br />ordinance shall be in fu11 force an,d effect from and immediately after its passage <br />and approval by the Mayor. <br />Passe <br />. <br />Attest , ' ? ? 1 <br />Florence Holm, Clerk of Council Francis J. 0'Neill Pr . of Council <br />APPROVED : <br />Ralph .
