CITY OF NORTH OLMSTED <br />ORDINANCE NO. 66- 303 <br />BY? <br />AN ORDINANCE AUTHORIZING THE MAYOR TO DEED AN <br />EASEMENT PREVIOUSLY ACQUIRED FOR THE SANITARY <br />SEWER SYSTEM, AND NOW NO LONGER NECESSARY, <br />TO PATE HOMES, INC., AND FURTHER AUTHORIZING <br />THE MAYOR TO ACCEPT AN EASEMENT FOR THE <br />SANITARY SEWER SYSTEM FROM SNIDER BUILDING <br />CORPORATION AND DECLARING AN EMERGENCY <br />W:EEREAS, Pate Homes, Inc. has previously furnished the City of <br />North Olmsted a sanitary sewer easement through Sublot No. 19B and 20B in <br />the Bretton Ridge Subdivision to the City of North Olmsted; and <br />WiiEREAS, it is necessary to move the sanitary sewer to a different <br />location and, therefore, the sanitary sewer easement through Sublot 19B and 20B <br />in the Bretton Ridge Subdivi;sion No. 3 no longer is needed; and <br />WHEREAS, a new easement is necessary in Sublot 17B in the Bretton <br />Ridge Subdivision No. 3 and the owner of said easement, Snider Building <br />Corporation, is willing to deed the sanitary sewer easement to the City of <br />North Olmsted; and <br />WHEREAS, said easement is necessary for the sanitary sewer program; <br />and ' <br />WHEREAS, Council, being fully advised that time is of the essence in <br />acquiring the sanitary sewer easement, and that the said acquiring of the <br />sewer easement is conditioned upon the fact that the City of North Olmsted <br />relinquish all its right and title to the previously acquired sanitary sewer <br />easement in Sublot No. 19B. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio: . <br />Section 1: That the Mayor of the City of North Olmsted is hereby <br />authorized to accept from Snider Building Corporation a sanitary sewer easement <br />on Sublot No. 17B in the Bretton Ridge Subdivision No. 3. <br />Section 2: That the Mayor is hereby authorized to deed to Pate Homes, <br />Inc. a sanitary sewer and sidewalk easement on Sublot Nos. 19B and ZOB as shown <br />in the recorded plat of Bretton Ridge Subdivision No. 3, which easement is no <br />longer needed by the City of North Olmsted for the construction of a sanitary <br />sewer or for any other purpose and, therefore, becomes surplus property. <br />? Section 3:, That this Ordinance is hereby declared to be an emergency <br />measure necessary for the preservation of the public peace, health, safety and <br />welfare of the City b.y virtue of the fact that the construction of the sanitary <br />sewers must continue in order to protect the health and welfare of the citizens <br />of the City of North Olmsted.
