<br />OHIO, BY INSTALLZNG A SANITARY SEWER, SELdER CURB CONNECTTONS
<br />AND OTHER NECESSAF$?,APPURTENANCES AND DECLARING AN EMERGENCY.

<br />BE IT RESOLVED by the Council of tCity of North Olmsted, Cuyahoga
<br />County, Ohio, three-fourths of all members elected thereto concurring:
<br />A RESOL["ION DECLARING TT NECESSARY TO INg'ROVE CANTE
<br />RBURY
<br />Section l. That it is necessary to improve in the City of North
<br />O.lmsted, Ohio, Canterbury Hoad from a point 67 feet south of the north
<br />corporation line southerly to a point 190 feet north of the center line of
<br />Lorain Road by installing a sanitary sewer, sewer curb connections and other
<br />necessary appurtenances.
<br />? Section 2. Tha.t said street shall be improved as shown on the plans
<br />hereinafter referred to an,d now on file in the office of the Clerk of this
<br />Council.
<br />Section 3. It is hereby determined and declared that said improvement
<br />- is conducive to the public health, convenience and welfare of said City and
<br />the inhabitants thereof.
<br />Section 4. That the grade of said street and improvement shall be
<br />the grade as shown by the Engineer's plans and profiles which are made a part
<br />hereof.
<br />Section 5. That the'plans, specifications, estima,tes and profiles
<br />of the proposed improvement, heretofore prepared by Floyd G. Browne and
<br />Associates, Ltd., Consulting Engineers to the City, and now on file in the
<br />office oi the Clerk of this Council, are hereby approved.
<br />Section 6. That the whole cost of said improvement less 29 per
<br />cent thereof, which portion shall be borne by the City, shall be assessed in
<br />proport3on to the benefits resulting therefrom upon the following described
<br />lots and lands, to wit:
<br />A1.1 lots and la,nds bounding and abutting upon the proposed improvement
<br />between the termini aforesaid, which said lots and lands are hereby deternv.ned
<br />to be specially benefited by said improvement; and the cost of said improvement
<br />sha11 include the cost of prelimi.nary and other surveys, pl.ans, specifications,
<br />profiles and estimates and of printing, serving and publishing notices, resolutions
<br />and ordina,nces, the amount of dama,ges resulting from the improvement assessed in
<br />favor of any owner of land affected by the improvement and the interest thereon,
<br />the costs incurred in connection with the preparation, levy and collection of the
<br />special assessments, the cost of purchasing, appropriating, and otherwise acquiring
<br />therefor any required real estate or interests therein, expenses of 1ega1 ser-
<br />vices including obtaining an approving legal opinion, cost of labor and material
<br />and interest on bonds and notes issued in anticipation of the levy and collec-
<br />tion of the special assessments together with all other necessary expenditures.
<br />Section 7. That Floyd. G. Browne and Associates, Ltd., Consulting
<br />Engineers to the City, be and they are hereby authorized and directed to
<br />prepare and file in the office of the Clerk of this Council the estimated
<br />assessments of the cost of the improvement described in this resolution. Such
<br />estimated assessments shall be based upon the estima,te of cost of said improve-
<br />ment now on file in the office of the Clerk of this Council and sha11 be prepared
<br />? pursuant to the provisions of this resolution. tidhen such estimated assessments
<br />have been so filed, said Clerk sha11 cause notice of the adoption of this
<br />resolution and the fi'ling of said estimated assessments to be served on the
<br />owners of a11 lots and lands to be assessed as provided in R C§727.13.
<br />Section 8. That the assessments to be l.evied shall be paid in 20
<br />anriual installments, with interest on deferred paymento at the same rate as
<br />shall be borne by the bonds to be issued in anticipa,tion of the collection
