ORDINANCE NO . ?e G- a l <br />i ??,?, 7 <br />AN ORDINANCE DETERMINING TO PROCEED WITH TRE <br />IMPROVEMENT OF SOUTHERN AVENUE IN THE CITY <br />OF NORTH OLMSTED, OHIO, BY INSTALLING AN <br />8-INCH CAST IRON WATER MAIN WITH THE NECESSARY <br />AI'PURTENANCES INCLUDING WATER SERVICE CONNECTIONS <br />AND ALSO BY INSTALLING SAPTITARY SEWER CONNECTIONS,, <br />AND DECLAItING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North 01.mstedj, Cu}rahoga <br />County? Ohio: <br />, <br />Section 1. That it is hereby def.ermined to praceed with the improve- <br />ment Southern Avenue from the existing wa,ter main therein near Decker <br />Avenue west to McI{enzie Road by installing an 8-inch cast iron water main <br />? with the necessary appurtenances including water service connections and <br />improving Southern Avenue from N1aICenzie Road to a point 165 feet west of <br />Decker Avenue by installing sanitary sewer connections. <br />Section 2. That said improvement shall be made in accordance with <br />• the provisions of Resolution No. 65-277 passed on November 16, 1965, and <br />with the plans, specifications, estimates and profiles heretofore approved <br />and now on t'ile in the office of the Clerk of Council. <br />Section 3. That all claims for damages resulting therefrom that have <br />been legal17 filed shall be inquired into after completion of the proposed <br />improvement, and the Director of Law is hereby aufihorized and directed to <br />institute legal proceedings in a court of competent jurisdiction to inquire <br />into claims that have been so filed. <br />Section 4. That portion of the cost provided in the above-mentioned <br />resolution of necessity to be assessed sha.ll be assessed in the maruzer and <br />the number of installments provided in said resolution and on the lots and <br />la,nds descr3bed therein. <br />Sect3on 5. That the estimated assessm,ents heretofore prepared and <br />filed in the offYce of the Clerk of Council be and the same are hereby <br />adopted. <br />Section 6. The Clerk of Council is hereby directed to deliver a <br />cert3f3ed copy of this ordina.nce to the County Auditor within fifteen <br />days after its passage. <br />Section 7. Subject to the provisions of Section 727.24, Revised Code, <br />the Ma.yor of the City is hereby authorized and directed as soon as the <br />funds therefor are available to make and -execute a contract for said imprnve- <br />ment w3.th the lowest and best bidder after advertising according to law and <br />the improvement shall be financed as prov3.ded in the resolution of necessity. <br />Section 8. This ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the pub].ic peace, <br />health and safety of said City and for the further reason that the <br />immediate construction of said improvement is necessary to afford fire <br />protectioii and to protect the health of the abutting owners and the <br />inhabitants of the City; wherefore, this ordinance sha,ll be in fu1l <br />force and effect from and immediately after its passage and approval <br />by the Mayor. <br />, <br />?. fY <br />Passed: <br />President of Cm?ncil <br />? <br />Attest: - ? f G f G 4 , 1.966 <br />Approved <br />? <br />Mayor <br />C, <br />+? o??
