<br />CURB CONNECTIONS AND OTHER NECESSARY APPURTE-
<br />NA.IVCES, REPEALIPdG RESOLUTION N0. 66 -21& PASSED
<br />SEPTEMLiER 6, 1966, AND DECLARING AN EMERGENCY.
<br />BE IT RESOLVED by the Council of the City of North Olmsted,, Cu}rahoga
<br />County, Ohio, three-fourths of all members elected thereto concurring:
<br />Section 1. That it is necessary to improve in the City of North
<br />Olmsted, Ohio, Ganterbury Road from a point 67 feet south of the north
<br />corporation line southerly to a point 190 feet north of the center line
<br />of Lorain Road and Sweetbriar Drive from a point 280 feet west of the
<br />i? center line of Canterbury Road westerly 726 feet to an existing manhole
<br />i in Sweetbriar Drive by installing sanitary sewers, sewer curb connections
<br />? and other necesyary appurt.enances.
<br />Section 2. That said streets shall be improved as shown on the plans
<br />' hereinafter referred to and now on file in the office of the Clerk of this
<br />Council.
<br />Section 3. 2t is hereby determi.ned and declared that said improvements
<br />are conducive to the public health, convenience and welfare of said City and
<br />the inhabita,pts thereof. It,is further determined that said streets are so
<br />. s3tuated to each other that in order to complete the improvement thereof in
<br />the most practical and economical manner they should be improved at the same
<br />time, with the same kind of materials, and in the sa.me manner and treated as
<br />a single improvement.
<br />Section 4. That the grade of said streets and improvements shall be
<br />the grade as shown by the Engineer's plans and profiles which are made a
<br />part hereof.
<br />Section 5. That the plans, specifications, estimates and profiles of
<br />the proposed improvements, heretofore prepared by Floyd G. Browne and
<br />Associates, Ltd., Consulting Engineers to the City, and now on file in the
<br />office of the Clerk of this Council, are hereby approved.
<br />Section 6. That the whole cnst of sa3.d improvements less 25 per cent
<br />thereof, which portion sha,ll be borne by the City, shall be assessed in
<br />proportion to the benefits resulting therefrom upon the fo].lowing described
<br />lots and lands, to wit:
<br />A7.1 lots and lands bounding and abutting upon the proposed improvement
<br />between the terrnini aforesaid, which said lots and lands are hereby determined
<br />to be specially benefited by said improvements; and the cost of said improve-
<br />ments shall include the cost of preliminary and a,ther surveys, plans., specifi-
<br />cations, profiles and estimates and of printing, serving and publishing notices,
<br />resolutions a.nd ordinances, the amount of da,mages resulting from the improve-
<br />ment assessed in favor of any owner of land affected by the improvement and the
<br />interest thereon, the costs incurred in connection with the preparation, levy
<br />and collection of the special assessments, the cost of purchasing, appropriating,
<br />and otherwise acquiring therefor any required real estate or interests therein,
<br />expense of legal services including obtaining an approving legal opinion, cost
<br />r of labor and material and interest on bonds and notes issued in anticipation of
<br />the levy and collection of the special assessments together with all other neces-
<br />sary expenditures. ,
<br />Section 7. That F1oyd G. Browne and Associates.. Ltd., Consulting
<br />Engineers to the City, be and they are hereby authorized and directed to
<br />prepare and file in the office of the Clerk of this Council the estimated
<br />assessments of the cost of the improvements described in this resolution.
<br />Such estimated assessments sha11 be based upon the estimate of cost of
<br />said improvements now on file in the office of the Qerk of this Council
<br />and sha11 be prepa,red pursua,nt to the provisions of this resolution. When
<br />such estimated assessments have been so filed, said Clerk shall cause notice
<br />of the adoption of this resolution and the filing of said estima,ted as-
<br />sessments ta be served on the owners of all lots and lands to be assessed'` ?
