d <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 65 - <br />BY <br />A RESOLUTION AUTHORIZING THE TRANSFER OF THE SANITARY <br />SEWAGE TREATMENT PLANT WITHIN PARK RIDGE DEVELOPMENT <br />TO THE CITY OF NORTH OLMSTED, OHIO, AND DECLARiNG <br />AN EMERGENCY. <br />C; <br />WHEREAS, the Engineer of the City of North Olmsted has reported <br />to Council that the sanitary sewage treatment plant in the Park Ridge Development <br />has been completed according to the ordinances regulating the sanitary sewage <br />treatment plants within the City of North Olmsted and is serving certain users <br />within the said Sabdivision at the present time, and <br />WHEREAS, the City of North Olmsted now wishes to authorize <br />and completP the ±-ansfer of the operation and the maintenace ef said sewage <br />treatment plant to the City of North Olmsted, and <br />WHEREAS, the City of North Olmsted wishes to establish the <br />require:nents r.ecessary for the transfer of title to said plant to the City of <br />North Olmsted and the assumption by the City of the operation thereof. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL of the City <br />of Nortn Olmsted, State of Ohio: <br />Section l: That the Council of the City of North Olmsted does <br />he-eby accopt f(_)r the C%lty of North Olmsted the sani±ary sewage treatment <br />plant constructed within the Fark Ridge Development as meeting the requirements <br />of the ordinar.ces of the City, and will formally accept said plant upon the <br />compliance by the developer and/or owners of the conditions hereinafter set <br />fort'li in Section 2. <br />Section 2: That there be furnished to the City of North Olmsted <br />an affidavit of completion in which it is stated that the sewage treatment plant <br />is entirel?- completed and that all material men and labor have been pa+d, <br />that the City be furnished a bond in the amount of Six_ Thousand Dollars ($6, 000 . 00) , <br />guarantGeing said plant for a period of one (1) year aqainst all structural and <br />mechanical deferts and warranting the components therein for a period of one (1) <br />vear from the acceotance by the City of the delivery oi title to said plant and <br />the assumption by the City of the ope-ation thereof, and that the City be furnished <br />a warranty deed conveying a fee title to said premises to the City, free and clear <br />of all encum'Drances wliatsoever. <br />?
